9. The Committee against Torture, acting under article 22, paragraph 7, of the Convention against Torture and Other Cruel, Inhuman or Degrading Treatment or Punishment, concludes that the removal of the complainants to Azerbaijan would not constitute a breach of article 3 of the Convention.
9- وتخلص لجنة مناهضة التعذيب، عملاً بموجب الفقرة 7 من المادة 22 من اتفاقية مناهضة التعذيب وغيره من ضروب المعاملة أو العقوبة القاسية أو اللاإنسانية أو المهينة، إلى أن إبعاد صاحبي الشكوى إلى أذربيجان، لا يشكل انتهاكاً للمادة 3 من الاتفاقية.

1.2 Under rule 108, paragraph 1, of the Committee's rules of procedure, the Committee requested the State party, not to expel the complainants to Turkey while their complaint was under consideration by the Committee.

7.9 The Committee against Torture, acting under article 22, paragraph 7, of the Convention against Torture and Other Inhuman or Degrading Treatment or Punishment, considers that the State party's decision to return the complainants to Turkey would constitute a breach of article 3 of the Convention.
7-9 إن لجنة مناهضة التعذيب، إذ تتصرف بمقتضى الفقرة 7 من المادة 22 من اتفاقية مناهضة التعذيب وغيره من ضروب المعاملة أو العقوبة القاسية أو اللاإنسانية أو المهينة، ترى أن قرار الدولة الطرف بإعادة صاحبي الشكوى إلى تركيا سيشكل انتهاكاً للمادة 3 من الاتفاقية.

7.1 The issue before the Committee is whether the removal of the complainants to Azerbaijan would violate the State party's obligation under article 3 of the Convention not to expel or to return a person to another State where there are substantial grounds for believing that he or she would be in danger of being subjected to torture.
7-1- المسألة التي يتعين على اللجنة البت فيها هي معرفة ما إذا كان إبعاد صاحبي الشكوى إلى أذربيجان ينطوي على انتهاك الدولة الطرف لالتزامها بموجب المادة 3 من الاتفاقية القاضي بعدم طرد أو إعادة شخص إلى دولة أخرى إذا توافرت لديها أسباب حقيقية تدعو إلى الاعتقاد بأنه سيواجه خطر التعرض للتعذيب.

10. Accordingly, the Committee against Torture, acting under article 22, paragraph 7, of the Convention against Torture and Other Cruel, Inhuman or Degrading Treatment or Punishment, concludes that the removal of the complainants to China by the State party would not constitute a breach of article 3 of the Convention.
10- وبناء عليه، تخلص لجنة مناهضة التعذيب، متصرفةً عملاً بالفقرة 7 من المادة 22 من اتفاقية مناهضة التعذيب وغيره من ضروب المعاملة أو العقوبة القاسية أو اللاإنسانية أو المهينة، إلى أن القرار الذي اتخذته الدولة الطرف بشأن إعادة صاحبي الشكوى إلى الصين لا يشكل انتهاكاً للمادة 3 من الاتفاقية.

1.2 On 29 November 2010, under rule 114, paragraph 1 (former rule 108, paragraph 1), of its rules of procedure (CAT/C/3/Rev.5), the Committee requested the State party to refrain from expelling the complainants to Tunisia while their complaint was under consideration by the Committee.
1-2 وفي 29 تشرين الثاني/نوفمبر 2010، طلبت اللجنة إلى الدولة الطرف، بموجب الفقرة 1 من المادة 114 من نظامها الداخلي (CAT/C/3/Rev.5) (الفقرة 1 من المادة 108 سابقاً)، الامتناع عن طرد صاحبي الشكوى إلى تونس بينما الشكوى قيد نظر اللجنة.

10- وبناءً عليه، تخلص لجنة مناهضة التعذيب، متصرفةً بموجب الفقرة 7 من المادة 22 من اتفاقية مناهضة التعذيب وغيره من ضروب المعاملة أو العقوبة القاسية أو اللاإنسانية أو المهينة، إلى أن القرار الذي اتخذته الدولة الطرف بشأن إعادة صاحبي الشكوى إلى الصين لا يشكل انتهاكاً للمادة 3 من الاتفاقية.

7.2 The issue before the Committee is whether the removal of the complainants to Tunisia would violate the State party's obligation under article 3 of the Convention not to expel or to return (refouler) a person to another State where there are substantial grounds for believing that he or she would be in danger of being subjected to torture.
7-2 وتتمثل المسألة المعروضة على اللجنة في البت ما إذا كان ترحيل صاحبي الشكوى إلى تونس سيشكل انتهاكا لالتزام الدولة الطرف بموجب المادة 3 من الاتفاقية، وهو عدم طرد أو إعادة (إبعاد) أي شخص إلى دولة أخرى إذا توافرت لديها أسباب حقيقية تدعو إلى الاعتقاد بأنه سيواجه فيها خطر التعرض للتعذيب.
