1.2 Under rule 114 (former rule 108) of its rules of procedure (CAT/C/3/Rev.5), the Committee requested the State party, on 31 March 2010, to refrain from expelling the complainant to China while his communication is under consideration by the Committee.
1-2 وفي 31 آذار/مارس 2010، طلبت اللجنة إلى الدولة الطرف، بموجب المادة 114 (المادة 108 سابقاً) من نظامها الداخلي (CAT/C/3/Rev.5)، عدم طرد صاحب الشكوى إلى الصين ريثما تنظر اللجنة في بلاغه.

8. The Committee against Torture, acting under article 22, paragraph 7, of the Convention against Torture and Other Cruel, Inhuman or Degrading Treatment or Punishment, therefore concludes that the deportation of the complainant to China would constitute a violation of article 3 of the Convention.
8- وبناء عليه، فإن لجنة مناهضة التعذيب، إذ تتصرّف بموجب الفقرة 7 من المادة 22 من اتفاقية مناهضة التعذيب وغيره من ضروب المعاملة أو العقوبة القاسية أو اللاإنسانية أو المهينة، تخلص إلى أن ترحيل صاحب الشكوى إلى الصين يشكل خرقاً للمادة 3 من الاتفاقية.

8. The Committee against Torture, acting under article 22, paragraph 7, of the Convention against Torture and Other Inhuman or Degrading Treatment or Punishment, concludes that the deportation of the complainant to China did not constitute a violation of article 3 of the Convention.
7-8 وإن لجنة مناهضة التعذيب، إذ تتصرف بموجب الفقرة 7 من المادة 22 من اتفاقية مناهضة التعذيب وغيره من ضروب المعاملة أو العقوبة القاسية أو اللاإنسانية أو المهينة، تخلص إلى أن ترحيل صاحب الشكوى إلى الصين لم يشكل خرقاً للمادة 3 من الاتفاقية.

7.2 The issue before the Committee is whether the removal of the complainant to China would violate the State party's obligation under article 3 of the Convention not to expel or to return (refouler) a person to another State where there are substantial grounds for believing that he or she would be in danger of being subjected to torture.
7-2 والمسألة المعروضة أمام اللجنة هي ما إذا كان طرد صاحب الشكوى إلى الصين سيشكل انتهاكاً لالتزام الدولة الطرف بموجب المادة 3 من الاتفاقية بألا تطرد أي شخص أو تعيده (تردّه) إلى دولة أخرى إذا توافرت لديها أسباب حقيقية تدعو إلى الاعتقاد بأنه سيواجه خطر التعرض للتعذيب.
