At the same time, the Committee, acting in accordance with rule 108, paragraph 9, of its rules of procedure, requested the State party not to deport the complainant to Pakistan pending the Committee's consideration of his complaint.
وفي الوقت ذاته، طلبت اللجنة إلى الدولة الطرف، عملاًَ بالفقرة 9 من المادة 108 من نظامها الداخلي، عدم ترحيل صاحب الشكوى إلى باكستان طالما بقيت شكواه قيد النظر.

16.2 The issue before the Committee is thus whether the removal of the complainant to Pakistan despite the Committee's request for interim measures violated his rights under article 3 or 22 of the Convention.
16-2 وهكذا فإن المسألة المعروضة على اللجنة هي هل كان إبعاد صاحب الشكوى إلى باكستان على الرغم من طلب اللجنة اتخاذ تدابير مؤقتة هو انتهاك لحقوقه بموجب المادة 3 أو المادة 22 من الاتفاقية.

9. Consequently, the Committee against Torture, acting under article 22, paragraph 7, of the Convention against Torture and Other Cruel, Inhuman or Degrading Treatment or Punishment, is of the view that the return of the complainant to Pakistan would not constitute a breach by the State party of article 3 of the Convention.
9- وعليه، فإن لجنة مناهضة التعذيب، إذ تعمل بموجب الفقرة 7 من المادة 22 من اتفاقية مناهضة التعذيب وغيره من ضروب المعاملة أو العقوبة القاسية أو اللاإنسانية أو المهينة، ترى أن إعادة صاحب الشكوى إلى باكستان لا تشكل خرقاً من الدولة الطرف لأحكام المادة 3 من الاتفاقية.

6.2 The first issue before the Committee is whether return of the complainant to Pakistan would constitute a violation of the obligation of the State party, under article 3 of the Convention, not to expel or return a person to a State where there are substantial grounds for believing that he would be in danger of being subjected to torture.
6-2 والمسألة الأولى المعروضة على اللجنة هي تحديد ما إذا كانت عودة صاحب الشكوى إلى باكستان تشكل انتهاكاً لالتزام الدولة الطرف بموجب المادة 3 من الاتفاقية بعدم طرد شخص أو إعادته إلى دولة أخرى إذا كانت هناك أسباب حقيقية تدعو إلى الاعتقاد بأنه سيواجه خطر التعرض للتعذيب.

Accordingly, the Committee against Torture, acting under article 22, paragraph 7, of the Convention against Torture and Other Cruel, Inhuman or Degrading Treatment or Punishment, is of the view that the return of the complainant to Pakistan does not reveal a breach of article 3 of the Convention. 7- وعليه، فإن لجنة مناهضة التعذيب، إذ تتصرف بموجب الفقرة 7 من المادة 22 من اتفاقية مناهضة التعذيب وغيره من ضروب المعاملة أو العقوبة القاسية أو اللاإنسانية أو المهينة، ترى أن عودة صاحب الشكوى إلى باكستان لا تكشف عن انتهاك للمادة 3 من الاتفاقية.

1.2 By note verbale of 2 April 2004, the Committee transmitted the complaint to the State party, together with a request under rule 108, paragraph 1, of the Committee's rules of procedure, not to expel the complainant to Pakistan pending the Committee's consideration of his complaint.
1-2 وأحالت اللجنة الشكوى إلى الدولة الطرف، بمذكرة شفوية مؤرخة 2 نيسان/أبريل 2004، مشفوعة بطلب بموجب الفقرة 1 من المادة 108 من النظام الداخلي للجنة بعدم طرد صاحب الشكوى إلى باكستان إلى أن تنظر اللجنة في شكواه.

17. The Committee against Torture, acting under article 22, paragraph 7, of the Convention against Torture and Other Cruel, Inhuman or Degrading Treatment or Punishment, considers that the deportation of the complainant to Pakistan despite standing interim measures, constituted a breach of article 22 of the Convention, as long as the complainant was under the jurisdiction of Pakistan from 22 September 2005 to 31 March 2006.
17- وترى لجنة مناهضة التعذيب، وهي تتصرف بموجب الفقرة 7 من المادة 22 من اتفاقية مناهضة التعذيب وغيره من ضروب المعاملة أو العقوبة القاسية أو اللاإنسانية أو المهينة، أن ترحيل صاحب الشكوى إلى باكستان على الرغم من التدابير المؤقتة القائمة يشكل خرقاً للمادة 22 من الاتفاقية استمر طوال الفترة التي كان فيها صاحب الشكوى خاضعاً لولاية باكستان القضائية من 22 أيلول/سبتمبر 2005 إلى 31 آذار/مارس 2006.
