1.2 On 18 August 1999 the Committee transmitted the complaint to the State party; pursuant to rule 108, paragraph 9, of the Committee's rules of procedure, the State party was requested not to expel the complainant to Turkey, pending consideration of his case by the Committee.

7. The Committee against Torture, acting under article 22, paragraph 7, of the Convention against Torture and Other Cruel, Inhuman or Degrading Treatment or Punishment, concludes that the removal of the complainant to Turkey would not constitute a breach of article 3 of the Convention.

1.2 On 11 September 2002, the Committee forwarded the complaint to the State party for comments and requested, under rule 108, paragraph 1, of the Committee's rules of procedure, not to extradite the complainant to Turkey while his complaint was under consideration by the Committee.

14. The Committee against Torture, acting under article 22, paragraph 7, of the Convention against Torture and Other Cruel, Inhuman or Degrading Treatment or Punishment, concludes that the State party's decision to return the complainant to Turkey does not constitute a breach of article 3 of the Convention.
14- وإن لجنة مناهضة التعذيب، عملاً بأحكام الفقرة 7 من المادة 22 من اتفاقية مناهضة التعذيب وغيره من ضروب المعاملة أو العقوبة القاسية أو اللاإنسانية أو المهينة، تخلص إلى أن قرار الدولة الطرف بإعادة صاحب الشكوى إلى تركيا لا يشكل خرقاً لأحكام المادة 3 من الاتفاقية.

1.2 On 31 January 2002, the Committee forwarded the complaint to the State party for comments and requested, under rule 108 of the Committee's rules of procedure, not to expel the complainant to Turkey while his complaint was under consideration by the Committee.
1-2 أحالت اللجنة الشكوى إلى الدولة الطرف بتاريخ 31 كانون الثاني/يناير 2002 لإبداء تعليقاتها عليها، وطلبت إليها، بموجب المادة 108 من النظام الداخلي للجنة، ألا تُبعد صاحب الشكوى إلى تركيا بينما لا تزال شكواه موضع نظر اللجنة.

7.1 The issue before the Committee is whether removal of the complainant to Turkey would violate the State party's obligation under article 3 of the Convention not to expel or to return a person to another State where there are substantial grounds for believing that he or she would be in danger of being subjected to torture.
7-1 وفحوى المسألة المعروضة على اللجنة هو ما إذا كان ترحيل صاحب الشكوى إلى تركيا يشكل انتهاكاً لالتزام الدولة الطرف بموجب المادة 3 من الاتفاقية التي تقضي بعدم إبعاد أو إعادة شخص ما إلى دولة أخرى يمكن أن يوجد فيها من الأسباب الجوهرية ما يدعو إلى الاعتقاد بأنه عرضة لخطر التعذيب.

10- وعليه، فإن لجنة مناهضة التعذيب، إذ تتصرف بموجب الفقرة 7 من المادة 22 من اتفاقية مناهضة التعذيب وغير ذلك من ضروب المعاملة أو العقوبة القاسية أو اللاإنسانية أو المهينة، تخلص إلى أن عودة صاحب الشكوى إلى تركيا لا تشكل انتهاكاً للمادة 3 من الاتفاقية.

10- وعليه، فإن لجنة مناهضة التعذيب، إذ تتصرف بموجب الفقرة 7 من المادة 22 من اتفاقية مناهضة التعذيب وغير ذلك من ضروب المعاملة أو العقوبة القاسية أو اللاإنسانية أو المهينة، تخلص إلى أن عودة صاحب الشكوى إلى تركيا لن تشكل انتهاكاً للمادة 3 من الاتفاقية.

1.2 In accordance with article 22, paragraph 3, of the Convention, while transmitting the communication to the State party, on 29 September 2009, the Committee requested it, under rule 108, paragraph 1, of the Committee's rules of procedure, not to expel the complainant to Turkey while his communication was under consideration.
1-2 وعند إحالة البلاغ إلى الدولة الطرف في 29 أيلول/سبتمبر 2009، عملاً بالفقرة 3 من المادة 22 من الاتفاقية، طلبت منها اللجنة، وفقاً للفقرة 1 من المادة 108 من النظام الداخلي للجنة، عدم ترحيل صاحب الشكوى إلى تركيا ما دام بلاغه قيد النظر.

In the light of the above considerations and in the absence of further pertinent information on file, the Committee against Torture, acting under article 22, paragraph 7, of the Convention against Torture and Other Cruel, Inhuman or Degrading Treatment or Punishment, concludes that the deportation of the complainant to Turkey by the State party did not constitute a violation of article 3 of the Convention.
٩- وفي ضوء الاعتبارات أعلاه وفي ضوء خلو الملف من معلومات أخرى في صميم الموضوع، تخلص لجنة مناهضة التعذيب، وهي تتصرف عملاً بالفقرة 7 من المادة 22 من اتفاقية مناهضة التعذيب وغيره من ضروب المعاملة أو العقوبة القاسية أو اللاإنسانية أو المهينة، إلى أن ترحيل صاحب الشكوى إلى تركيا لا يشكل انتهاكاً للمادة 3 من الاتفاقية.
