٩ - ووفقاً لما هو منصوص عليه في قرار الجمعية العامة 48/263 وفي اتفاق عام 1994 نفسه، ينبغي تفسير وتطبيق أحكام اتفاق عام 1994 والجزء الحادي عشر من الاتفاقية معا بوصفهما صكا واحدا.

٤ - ليس من الواضح ، فيما يتعلق باتفاقية مكافحة الجريمة المنظمة عبر الوطنية ، ما تعنيه عبارة " تقرأ وتفسر الاتفاقية والبروتوكول ما بوصفهما صكا واحدا )أي ما اذا كانت جميع اﻷدوات المنصوص عليها في الاتفاقية ستنطبق على الفعل الذي جرّم في البروتوكول ، وطبيعة العلاقة بين البروتوكول ونطاق الاتفاقية( .
