36. In most such cases, victims of torture or ill-treatment who want justice to be done have to resort themselves to initiating prosecutions.
٦٣- وفي معظم هذه الحالات، يتعين على ضحايا التعذيب أو إساءة المعاملة الذين يبغون إنصافهم أن يعمَدوا أنفسُهم إلى إقامة دعاوى قضائية.

It should, in practice, provide all victims of torture or ill-treatment with redress, including fair and adequate compensation, and as full rehabilitation as possible, and should allocate the necessary resources for the effective implementation of rehabilitation programmes.

21. While noting the information provided by the State party that victims of torture or ill-treatment have a legal right to obtain compensation, the Committee is nevertheless concerned at the difficulties that certain victims face obtaining redress and adequate compensation.
21- إن اللجنة، إذ تحيط علما بما قدمته الدولة الطرف من معلومات مفادها أن ضحايا التعذيب أو إساءة المعاملة يحق لهم قانونا الحصول على تعويض، يساورها مع ذلك قلق بشأن ما يواجهه بعض الضحايا من صعوبات في الحصول على الجبر والتعويض المناسب.

The Principles state that alleged victims of torture or ill-treatment, witnesses, those conducting the investigation and their families shall be protected from violence, threats of violence or any form of intimidation that may arise pursuant to the investigation (para. 3 (b)).
وتنص المبادئ على أن تُكفل حماية المدعى بكونهم ضحايا التعذيب أو إساءة المعاملة والشهود والقائمين بالتحقيق وأُسَرِهم من العنف أو التهديدات بالعنف أو أي شكل آخر من أشكال التخويف التي قد تنشأ نتيجة لإجراء التحقيق (الفقرة 3 (ب)).

The Committee further recommends that medical personnel, social staff in reception centres and others involved in the refugee status determination procedure should receive thorough training and sensitization in respect of victims of torture or ill-treatment in order to identify such cases at an early stage for referral to the appropriate medical and psychosocial services.
وتوصي اللجنة أيضاً بضرورة توفير تدريب شامل بشأن ضحايا التعذيب أو إساءة المعاملة يخصص للعاملين في المجال الطبي والموظفين الاجتماعيين العاملين في مراكز الاستقبال وغيرهم من المعنيين بإجراءات تحديد مركز اللاجئين، وبهدف توعيتهم بهذا الأمر وتمكينهم من التعرف على هذه الحالات في مرحلة مبكرة وإحالتها إلى الدوائر الطبية والنفسية المناسبة.
