At the substantive level, States parties shall ensure that victims of torture or ill-treatment obtain full and effective redress and reparation, including compensation and the means for as full rehabilitation as possible.

The Committee is therefore of the view that a State party may not implement development measures or provide humanitarian assistance as a substitute for redress for victims of torture or ill-treatment.

164. In most cases, victims of torture or ill-treatment who want justice to be done have to resort to initiating prosecutions themselves. But the relevant legal provisions are difficult to enforce.
١٦٤ - وفي معظم الحالات، يتعين على ضحايا التعذيب أو سوء المعاملة الذين يريدون تحقيق العدالة أن يلجأوا بأنفسهم لرفع الدعاوى، ولكن اﻷحكام القانونية ذات الصلة صعبة اﻹنفاذ.

(c) victims of torture or ill-treatment have the right to obtain redress and fair and adequate compensation, as provided for in article 14 of the Convention.

The Committee also regrets the absence of information on the measures taken by the State party to provide rehabilitation for the victims of torture or ill-treatment (art. 14).

It should, in practice, provide all victims of torture or ill-treatment with redress, including fair and adequate compensation, and as full rehabilitation as possible, and should allocate the necessary resources for the effective implementation of rehabilitation programmes;

(12) Despite the fact that there were no allegations of torture during the reporting period, the Committee is concerned about the absence of specific provisions on redress and compensation for victims of torture or ill-treatment (art. 14).

49. In the same general comment, the Committee also emphasized that judicial and non-judicial proceedings should apply gender-sensitive procedures which avoided revictimization and stigmatization of victims of torture or ill-treatment.
