1.1 The present case refers to two communications against Spain in connection with the same events.

16. By Orders of 2 June 1999 concerning requests for provisional measures submitted by Serbia and Montenegro in the cases against Spain and the United States, the Court decided that those cases were to be removed from its List for manifest lack of jurisdiction.
16 - وبموجب أمرين صادرين في 2 حزيران/يونيه 1999 بشأن طلبين لاتخاذ تدابير تحفظية قدمتهما صربيا والجبل الأسود في القضيتين المقامتين ضد إسبانيا والولايات المتحدة، قررت المحكمة شطب هاتين القضيتين من قائمتها لافتقارها البين لاختصاص النظر فيهما.

4.4 The State party maintained that the communication was inadmissible under article 22, paragraph 5 (a), of the Convention because the complainant had submitted a communication to the Human Rights Committee against Spain in respect of the same facts.
4-4 وتدفع الدولة الطرف أولاً بأن البلاغ غير مقبول بموجب الفقرة 5(أ) من المادة 22 من الاتفاقية، لأن صاحب البلاغ قدم إلى اللجنة المعنية بحقوق الإنسان بلاغاً ضد إسبانيا يتعلق بنفس الوقائع.
