In cases of domestic procurement, the solicitation documents may in addition stipulate that the tender security shall be issued by an issuer in this State;

3. Procuring entities are not required to impose tender security requirements in all procurement proceedings.

Such a rule facilitates participation, while protecting the interests of the procuring entity by permitting forfeiture of the tender security for modification or withdrawal following the deadline for submission of tenders.
فإيراد قاعدة من هذا النحو يسهّل المشاركة في المناقصة ويحمي في الوقت ذاته مصالح الجهة المشترية بالسماح بسقوط الحق في ضمانة العطاء في حالة تعديل العطاءات أو سحبها عقب حلول موعد تقديمها النهائي.

A failure to obtain the approval within the time specified in the solicitation documents shall not extend the period of effectiveness of submissions specified in the solicitation documents or the period of effectiveness of the tender security required under article 17 of this Law, unless extended under the provisions of this Law.
ولا يؤدِّي عدمُ الحصول على الموافقة في غضون الفترة المحددة في وثائق الالتماس إلى تمديد مدة سريان مفعول العروض المقدَّمة المحددة في تلك الوثائق أو مدة سريان مفعول ضمانة العطاء المطلوبة بمقتضى المادة 17 من هذا القانون، ما لم تمدَّد هذه المدة بموجب أحكام هذا القانون.

ولا يؤدي عدم الحصول على الموافقة في غضون الفترة المحددة في وثائق الالتماس إلى تمديد مدة سريان مفعول العروض المقدَّمة المحددة في تلك الوثائق أو مدة سريان مفعول ضمانة العطاء المطلوبة بمقتضى المادة 16 من هذا القانون.

Amended definitions are: " procurement " , " procurement contract " , " procuring entity " , " supplier or contractor " and " tender security " :
13- والتعاريف المعدَّلة هي: " الاشتراء " ، و " عقد الاشتراء " ، و " الجهة المشترية " ، و " المورِّد أو المقاول " ، و " ضمانة العطاء " :

(e) The definition of " tender security " now reflects the fact that a tender security is provided to the procuring entity upon the requirement of the procuring entity.
(ﻫ) يبيّن تعريف " ضمانة العطاء " الآن كون ضمانة العطاء تُقدَّم إلى الجهة المشترية بناءً على طلبها.

3. Where applicable, the procurement regulations should refer to any law of the enacting State that prohibits the acceptance by the procuring entity of the tender security that is not issued by an issuer in the enacting State.
3- وينبغي، لدى الانطباق، أن تشير لوائح الاشتراء إلى أي قانون في الدولة المشترعة يحظر أن تقبل الجهة المشترية ضمانة العطاء التي لا تصدرها جهة إصدار في الدولة المشترعة.

It was further emphasized that one of the purposes of a tender security -- to relieve concerns of the procuring entity as regards the qualifications and capacities of suppliers or contractors in the procurement proceedings -- should not be overlooked in the commentary to article 17 of the 2011 Model Law.
كما شُدِّد على أنَّ أحد أغراض ضمانة العطاء - وهو تبديد مخاوف الجهة المشترية بشأن مؤهّلات وقدرات المورِّد أو المقاول المشارك في إجراءات الاشتراء - لا ينبغي إغفاله في التعليق على المادة 17 من القانون النموذجي لعام 2011.

With respect to subparagraph (e), concern was expressed about the use of the term " submission security " instead of " tender security " .
55- فيما يتعلق بالفقرة الفرعية (ﻫ)، أُبدي قلق بشأن استخدام تعبير " ضمانة العرض " بدلاً من " ضمانة العطاء " .

The proposal was made to include at the end of the last sentence the phrase " unless the extension has been granted to the procuring entity by suppliers or contractors that presented submissions and the entities that provided the tender security. "
65- اقتُرح أن تُدرَج في نهاية الجملة الأخيرة العبارة التالية: " ما لم يكن هذا التمديد قد مُنح للجهة المشترية من المورِّدين أو المقاولين الذين قدّموا العروض والجهات التي وفّرت ضمانة العطاء " .

(b) The solicitation documents may stipulate that the issuer of the tender security and the confirmer, if any, of the tender security, as well as the form and terms of the tender security, must be acceptable to the procuring entity.
(ب) يجوزُ أن تَنُصَّ وثائقُ الالتماس على وجوب أن يكون كلٌّ من مُصدِر ضمانة العطاء والمصادِق عليها، إن وُجد، وكذلك شكل تلك الضمانة وأحكامها، مقبولاً لدى الجهة المشترية.

Although the Model Law refers to " tender security " (definition (t)), this reference does not imply that this type of security may be requested only in tendering proceedings.
13- وعلى الرغم من أنَّ القانون النموذجي يشير إلى تعبير " ضمانة العطاء " (التعريف (ر))، فإنَّ ذلك لا يعني ضمناً أنَّ هذا النوع من الضمانات لا يمكن طلبه إلاّ في إجراءات المناقصة.

As stated in the commentary to the definition of " tender security " in article 2, the Model Law refers to " tender security " as the commonly-used term in the relevant context, without implying that this type of security may be requested only in tendering proceedings.
وكما ذُكر في التعليق على تعريف " ضمانة العطاء " في المادة 2، فإنَّ القانون النموذجي يشير إلى " ضمانة العطاء " باعتبارها المصطلح الشائع الاستعمال في السياق ذي الصلة، دون أن يستلزم ذلك ضمناً أنَّ هذا النوع من الضمانات لا يمكن طلبه إلاّ في إجراءات المناقصة.

6. The reference to confirmation of the tender security in paragraph (1)(d) is intended to take account of the practice in some States of requiring local confirmation of a tender security issued abroad.
6- أما الإشارة إلى تأكيد ضمانة العطاء الواردة في الفقرة (1) (د) فيقصد بها مراعاة الممارسة المتّبعة في بعض الدول وهي اشتراط التأكيد المحلي لضمانة العطاء الصادرة في الخارج.

7. Paragraph (2) has been included in order to provide clarity and certainty as to the point of time after which the procuring entity may not make a claim under the tender security.
7- وأُدرجت الفقرة (2) توخِّيا للوضوح والتيقّن بشأن الموعد النهائي الذي لا يجوز للجهة المشترية، بعد حلوله، تقديم مطالبة بمقتضى ضمانة العطاء.

(b) The solicitation documents may stipulate that the issuer of the tender security and the confirmer, if any, of the tender security, as well as the form and terms of the tender security, must be acceptable to the procuring entity.
(ب) جاز أن تنصّ وثائق الالتماس على وجوب أن يكون مُصدِر ضمانة العطاء والمصادق عليها، إن وجد، وكذلك شكل تلك الضمانة وأحكامها، مقبولا لدى الجهة المشترية.

(c) Notwithstanding the provisions of subparagraph (b) of this paragraph, a tender security shall not be rejected by the procuring entity on the grounds that the tender security was not issued by an issuer in this State if the tender security and the issuer otherwise conform to requirements set out in the solicitation documents, unless the acceptance by the procuring entity of such a tender security would be in violation of a law of this State;
(ج) على الرغم من أحكام الفقرة الفرعية (ب) من هذه الفقرة، لا ترفض الجهةُ المشترية ضمانة العطاء بحجّة أنه لم يُصدِرها مُصدِرٌ في هذه الدولة إذا كانت تلك الضمانة ومُصدِرُها يفيان بالاشتراطات المبيَّنة في وثائق الالتماس، ما لم يكن قبولُ الجهة المشترية تلك الضمانة مخالفاً لأحد قوانين هذه الدولة؛

(f) The procuring entity shall specify in the solicitation documents any requirements with respect to the issuer and the nature, form, amount and other principal terms and conditions of the required tender security. Any requirement that refers directly or indirectly to the conduct of the supplier or contractor presenting the submission may relate only to:
