It was noted that under the revised formulation, the draft convention would apply to electronic messages exchanged between parties whose places of business were in different States even if those States were not both Contracting States of the Convention, so long as the law of a Contracting State applied to the dealings of the parties.
19- ولوحظ أنه بموجب الصيغة المنقحة سينطبق مشروع الاتفاقية على الرسائل الإلكترونية المتبادلة بين طرفين يوجد مقرّا عملهما في دولتين مختلفتين حتى وإن لم تكن تينك الدولتان كلتيهما دولتين متعاقدتين في الاتفاقية، ما دام قانون دولة متعاقدة ينطبق على المعاملة بين الطرفين.

26. The draft convention applies to the " use of electronic communications in connection with the formation or performance of a contract between parties whose places of business are in different States " .
