Where a contracting state makes extradition conditional on the existence of a treaty receives a request for extradition from another contracting state with which no extradition treaty exists the requested state may consider this convention as the basis for extradition in respect to the listed offences.
وعندما تتلقى دولة متعاقدة، تجعل التسليم مشروطا بوجود معاهدة، طلبا للتسليم من دولة متعاقدة أخرى لا توجد معها معاهدة تسليم فإنه يجوز للدولة المطلوب منها التسليم اعتبار هذه الاتفاقية أساس التسليم فيما يتعلق بالجرائم المذكورة فيها.

Considerable difficulties, legal as well as political, could well arise where a State party to one of these multilateral treaties which is not a State party to the statute of the court makes a request for extradition from a State which is a party both to the statute and to the multilateral treaty.
ويمكن أن تنشأ صعوبات كبيرة، قانونية وسياسية على حد سواء، حيث تقدم دولة طرف في إحدى هذه المعاهدات المتعددة اﻷطراف لا تكون دولة طرفا في النظام اﻷساسي الى المحكمة طلبا للتسليم من دولة تكون طرفا في النظام اﻷساسي والمعاهدة المتعددة اﻷطراف على السواء.

2. When a State Party which makes extradition conditional on the existence of a treaty receives a request for extradition from another State Party with which it has no extradition treaty, the requested State Party may, at its option, consider this Convention as a legal basis for extradition in respect of the offences set forth in article 2.
٢ - حينما تتلقى دولة طرف تشترط لتسليم المجرم وجود معاهدة لتسليم المجرم وجود معاهدة طلبا للتسليم من دولة طرف أخرى لا ترتبط معها بمعاهدة لتسليم المجرمين، يجوز للدولة المطلوب منها التسليم أن تعتبــر هــذه الاتفاقيــة، إذا شاءت، أساسا قانونيا للتسليم فيما يتعلق بالجرائم المنصوص عليها في المادة ٢.

2. If a State Party which makes extradition conditional on the existence of a treaty receives a request for extradition from another State Party with which it has no extradition treaty, it shall consider the present Convention as the legal basis for extradition in respect of those offences.
٢ - إذا تلقت دولة طرف تشترط لتسليم المجرم وجود معاهدة، طلبا للتسليم من دولة طرف أخرى لا ترتبط معها بمعاهدة لتسليم المجرمين، تعتبر الدولة المطلوب منها التسليم هذه الاتفاقية أساسا قانونيا للتسليم فيما يتعلق بتلك الجرائم.

2. When a State Party which makes extradition conditional on the existence of a treaty receives a request for extradition from another State Party with which it has no extradition treaty, the requested State Party may, at its option, consider this Convention as a legal basis for extradition in respect of the offences set forth in article 2.

٢ - إذا تلقت دولة طرف تشترط لتسليم المجرم وجود معاهدة، طلبا للتسليم من دولة طرف أخرى لا ترتبط معها بمعاهدة لتسليم المجرمين، جاز للدولة المطلوب منها التسليم أن تعتبر هذه الاتفاقية، إذا شاءت، أساسا قانونيا للتسليم فيما يتعلق بالجرائم المنصوص عليها في المادة ٢.

If a State Party which makes extradition conditional on the existence of a treaty receives a request for extradition from another State Party with which it has no extradition treaty, such a request shall constitute a sufficient legal basis for extradition in respect of the offences set forth in article 2.
٢ - إذا تلقت دولة طرف تشترط لتسليم المجرم وجود معاهدة، طلبا للتسليم من دولة طـرف أخــرى لا ترتبط معها بمعاهدة لتسليم المجرمين، فإن ذلك الطلب يشكل أساسا قانونيا كافيا للتسليم فيما يتعلق بالجرائم المنصوص عليها في المادة ٢.

In most countries, the fact that an offence was considered to involve fiscal matters did not constitute a ground for refusing an extradition request. One country under review had not refused a request for extradition on that ground, but the situation had been handled on an ad hoc basis and there was no legal basis for regulating the matter.
١١- وفي معظم البلدان لا تشكّل الجريمة التي تتعلق بأمور مالية سببا لرفض طلب التسليم؛ إذ لم ترفض إحدى الدول المستعرَضة طلبا للتسليم بناء على ذلك، وإنما عومل الطلب على حدة نظرا لعدم وجود أيِّ أساس قانوني لتنظيم هذه المسألة.
