Sixteen States reported having concluded agreements or arrangements dealing with the sharing of confiscated proceeds of crime in accordance with paragraph 3 (b) of article 14, which requires States parties to give special consideration to concluding agreements on sharing with other parties, on a regular or case-by-case basis, confiscated proceeds of crime or funds derived from such proceeds.

50. The group also expressed concern about the relationship between article 14 of the Organized Crime Convention, on disposal of confiscated proceeds of crime, and chapter V of the United Nations Convention against Corruption, focusing in particular on how States parties to both Conventions should deal with their implementation.
50- وأعرب الفريق أيضا عن قلقه إزاء العلاقة بين المادة 14 من اتفاقية الجريمة المنظّمة المتعلقة بالتصرف في عائدات الجرائم المصادرة والفصل الخامس من اتفاقية الأمم المتحدة لمكافحة الفساد الذي يركّز، بصورة خاصة، على كيفية قيام الدول الأطراف في الاتفاقيتين بتناول تنفيذهما.

2. When acting on the request made by another State Party in accordance with article 12 of this Convention, States Parties shall, to the extent permitted by domestic law and if so requested, give priority consideration to returning the confiscated proceeds of crime or property to the requesting State Party so that it can give compensation to the victims of the crime or return such proceeds of crime or property to their legitimate owners.
2- عندما تتخذ الدول الأطراف إجراء ما بناء على طلب دولة طرف أخرى، وفقا للمادة 12 من هذه الاتفاقية، تنظر تلك الدول على سبيل الأولوية، بالقدر الذي يسمح به قانونها الداخلي وإذا ما طلب منها ذلك، في رد عائدات الجرائم المصادرة أو الممتلكات المصادرة إلى الدولة الطرف الطالبة، لكي يتسنى لها تقديم تعويضات إلى ضحايا الجريمة أو رد عائدات الجرائم أو الممتلكات هذه إلى أصحابها الشرعيين.

It was recalled that in its resolution 5/8 the Conference had encouraged States parties to dispose of confiscated proceeds of crime or property in accordance with the provisions of article 14 of the Organized Crime Convention, giving priority consideration to returning the confiscated proceeds to the requesting State party, for the purpose of compensating the victims of the crime or return to the legitimate owners.
12- واستُذكِر أنَّ المؤتمر، في قراره 5/8، شجَّع الدولَ الأطراف على التصرُّف في عائدات الجرائم المصادرة أو الممتلكات المصادرة وفقا لأحكام المادة 14 من اتفاقية مكافحة الجريمة المنظَّمة، مع إيلاء الاعتبار على سبيل الأولوية لردّ العائدات المصادرة إلى الدولة الطرف الطالبة بغرض تعويض ضحايا الجريمة أو رد العائدات إلى أصحابها الشرعيين.

109.
