The Committee recalls its jurisprudence according to which the burden of proof should not rest solely on the author of a communication, especially given that the authors and the State party do not always have the same degree of access to evidence, and that often only the State party holds the necessary information.
وتذكر بآرائها السابقة() التي لا ينبغي بناء عليها أن يقع عبء الإثبات على عاتق صاحب البلاغ وحده وخصوصاً بالنظر إلى عدم تكافؤ الفرص على الدوام بين صاحب البلاغ والدولة الطرف للحصول على عناصر الإثبات، وإلى كون المعلومات اللازمة تكون في أغلب الأحيان في حوزة الدولة الطرف فقط.
