The right to be free from torture may not be subject to any limitation, anywhere, under any circumstances.

The author submits that this is not in conformity with the State party's obligations under article 2 of the Covenant, particularly in cases involving the right to life, or the right to be free from torture.

As Canada has abolished the death penalty, did it violate the author's right to life under article 6, his right not to be subjected to torture or to cruel, inhuman or degrading treatment or punishment under article 7, or his right to an effective remedy under article 2, paragraph 3, of the Covenant by deporting him to a State in which he was under sentence of death without ensuring that that sentence would not be carried out?

Article 16, paragraph 1, of the Migrants Protocol lays down an obligation for States parties to take all appropriate measures to preserve and protect the internationally recognized rights of smuggled migrants, and in particular the right to life and the right not to be subjected to torture or other cruel, inhuman or degrading treatment or punishment.

Moreover, article 16 of the Protocol lays down specific obligations for States parties to take all appropriate measures with a view to preserving and protecting the internationally recognized rights of smuggled migrants, including, in particular, the right not to be subjected to torture or other cruel, inhuman or degrading treatment or punishment (para. 1) and the right to be protected from violence (para. 2).

268. The most relevant rights in the context of the Darfur conflict are: (a) the right to life; (b) the right not to be subjected to arbitrary arrest or detention; (c) the right not to be subjected to torture or to cruel, inhuman or degrading treatment or punishment; (d) the right to effective remedy for any serious violations of human rights, which includes the obligation of State authorities to bring to justice perpetrators of such violations.
268 - وأكثر الحقوق صلة في سياق الصراع في دارفور هي: (أ) الحق في الحياة؛ (ب) والحق في عدم التعرض للاعتقال أو الاحتجاز التعسفي؛ (ج) والحق في عدم الخضوع للتعذيب أو للمعاملة أو العقوبة القاسية أو اللاإنسانية أو المهينة؛ (د) والحق في سبل الانتصاف الفعالة لأية انتهاكات خطيرة لحقوق الإنسان، والتي تشمل التزام سلطات الدولة بمحاكمة مرتكبي هذه الانتهاكات.
