Several persons, some resident in Tuvalu, were thereby made stateless as a result of the scheme and upon expiry of their passports, some will be both without citizenship and also unable to travel outside Tuvalu.
وقد أصبح العديد من الأشخاص، بعضهم مقيم في توفالو، عديمي الجنسية نتيجة لهذا البرنامج، كما أن آخرين سيصبحون بلا جنسية بعد انتهاء صلاحية جوازات سفرهم، وكذلك غير قادرين على مغادرة توفالو.

States concerned shall take all appropriate measures to prevent persons who, on the date of the succession of States, had the nationality of the predecessor State from becoming stateless as a result of such succession.
تتخذ الدول المعنية جميع التدابير المناسبة للحيلولة دون أن يصبح الأشخاص الذين كانوا في تاريخ خلافة الدول يتمتعون بجنسية الدولة السلف عديمي الجنسية نتيجة لهذه الخلافة.

Paragraph 2 obliged each State concerned to grant the right to opt for its nationality to persons concerned who had an appropriate connection with it if those persons would otherwise become stateless as a result of the succession.
أما الفقرة ٢ من هذه المادة فتُلزم كل دولة معنية منح اﻷشخاص المعنيين الذين تربطهم بها صلة مناسبة الحق في اختيار جنسيتها إذا كانوا سيصبحون، لولا ذلك، عديمي الجنسية نتيجة لخلافة الدول.

The States concerned are under the obligation to take all reasonable measures to avoid persons who, on the date of the succession of States, had the nationality of the predecessor State becoming stateless as a result of the said succession of States.
يقع على عاتق الدول المعنية التزام بأن تتخذ جميع التدابير المعقولة لتفادي تحول اﻷشخاص الذين كانوا يتمتعون في تاريخ خلافة الدول بجنسية الدولة السلف إلى أشخاص عديمي الجنسية نتيجة لتلك الخلافة.

UNHCR also commented on constitutional provisions or nationality legislation in States where large groups of the population are stateless as a result of being arbitrarily deprived of their nationality.
وعلقت المفوضية على الأحكام الدستورية أو التشريعات المتعلقة بالجنسية في الدول التي توجد فيها مجموعات كبيرة من السكان عديمي الجنسية نتيجة حرمانها تعسفاً من جنسيتها.

2. Each State concerned shall grant a right to opt for its nationality to persons concerned who have appropriate connection with that State if those persons would otherwise become stateless as a result of the succession of States.

Article 19 seems to give more weight to the provisions of Part I than to those of Part II. Thus article 10, paragraph 2, provides for granting the right of option only in the case of persons who would otherwise become stateless as a result of the succession, while articles 20, 23 and 26 seem to grant a much broader right of option.

The second safeguarded the right of States to treat persons concerned who had become stateless as a result of the succession of States as nationals of the State concerned whose nationality they would be entitled to acquire or retain, if such treatment was beneficial to those persons.
وأما الشرط الثاني فيكفل حق الدول في معاملة اﻷشخاص الذين أصبحوا عديمي الجنسية نتيجة لخلافة الدول كرعايــا للدولة المعنية التي يحـــق لهم اكتساب جنسيتها أو الاحتفــاظ بها إذا كانت هذه المعاملة في صالحهم.

20. The wording of article 18, paragraph 2, which allowed third States to treat persons who had become stateless as a result of a succession of States as nationals of the State concerned whose nationality they would be entitled to acquire or retain if such treatment was beneficial to them, was equally controversial.
٠٢ - ومما هو مدار جدل أيضا نص الفقرة ٢ من المادة ١٨ التي تجيز للدول معاملة اﻷشخاص المعنيين الذين أصبحوا عديمي الجنسية نتيجة لخلافة الدول، كرعايا للدولة المعنية التي يحق لهم اكتساب جنسيتها أو الاحتفاظ بها إذا كانت هذه المعاملة لصالح أولئك اﻷشخاص.

28. In that connection, a major step towards the development of international law had been taken with the formulation of article 11, paragraph 2, which provided that each State concerned should grant a right to opt for its nationality to persons concerned who had appropriate connection with that State if those persons would otherwise become stateless as a result of the succession of States.
