Such circumstances include incommunicado detention, prolonged solitary confinement, use of physical constraints in circumstances contrary to international standards, lack of essential medical care and treatment, imminent corporal punishment, and serious risk of extradition or deportation to a State or territory where the person in question would reportedly be in danger of being subjected to torture.

In his circumstances, a medical examination was necessary, in particular, in the light of the State party's obligation under article 3, paragraph 2, of the Convention, to take into account all relevant considerations to determine whether there are substantial grounds for believing that he would be in danger of being subjected to torture in the country of origin.

Indeed, diplomatic assurance has been proven to be unreliable, and cannot be considered an effective safeguard against torture and ill-treatment, particularly in States where there are reasonable grounds to believe that a person would face the danger of being subjected to torture or ill-treatment.
