In the context of framework agreements, the entity that awards a procurement contract is by definition the procuring entity for that procurement; the framework agreement itself allows for several potential purchasers at the second stage.
وفي سياق الاتفاقات الإطارية، تكون الجهة التي ترسي عقد اشتراء هي، بحكم تعريفها، الجهة المشترية في عملية الاشتراء تلك؛ ويسمح الاتفاق الإطاري نفسه بوجود عدة مشترين محتملين في المرحلة الثانية.

1. Any procurement contract under a framework agreement shall be awarded in accordance with the terms and conditions of the framework agreement and the provisions of this article.
1- يُرسَى أيُّ عقد اشتراء بمقتضى الاتفاق الإطاري وفقاً لأحكام ذلك الاتفاق وشروطه ووفقاً لأحكام هذه المادة.

2. A procurement contract under a framework agreement may be awarded only to a supplier or contractor that is a party to the framework agreement.
2- لا يجوزُ إرساء أيِّ عقد اشتراء بمقتضى الاتفاق الإطاري إلاَّ على مورِّد أو مقاول كان طرفاً في ذلك الاتفاق.

(x) Any formalities that will be required once a successful submission has been accepted for a procurement contract to enter into force, including, where applicable, the execution of a written procurement contract pursuant to article 22 of this Law;
`10` أيَّ إجراءات شكلية تصبح لازمة ما أنْ يُقبل العرض المقدّم الفائز لكي يبدأ نفاذ عقد الاشتراء، بما في ذلك، عندما يكون منطبقاً، إبرام عقد اشتراء كتابي بمقتضى المادة 22 من هذا القانون؛

(2) No procurement contract under the framework agreement may be awarded to suppliers or contractors that were not originally party to the framework agreement.
(2) لا يجوز إرساء أي عقد اشتراء بمقتضى الاتفاق الإطاري على مورّدين أو مقاولين لم يكونوا في الأصل طرفا في ذلك الاتفاق.

The procuring entity shall invite all suppliers or contractors that are parties to the framework agreement to submit tenders for the supply of the items to be procured for each procurement contract it proposes to award.
وتدعو الجهة المشترية جميع المورّدين أو المقاولين الأطراف في الاتفاق الإطاري إلى تقديم عطاءات لتوريد الأشياء المراد اشتراؤها فيما يتعلق بكل عقد اشتراء تقترح إرساءه.

Such a standstill period, it was noted, might avoid the need for any annulment as errors could be possibly corrected prior to the conclusion of the procurement contract, and it could also avoid the complication of having to set aside an executed procurement contract.
وذكر أن فترة التوقّف هذه قد تبطل الحاجة إلى أي إلغاء، لأنه يمكن تصحيح الأخطاء قبل إبرام عقد الاشتراء، كما يمكنها أن تحول دون التعقيدات المتمثلة في ضرورة فسخ عقد اشتراء مُبرَم.

(b) Whether a framework agreement and/or a purchase order under a framework agreement should constitute the procurement contract under the Model Law.
(ب) ما إذا كان ينبغي أن يشكّل اتفاق إطاري و/أو أمر شراء بمقتضى اتفاق إطاري عقد اشتراء بموجب القانون النموذجي.

From this perspective, as was explained, only in exceptional circumstances would a suspension be required, under the safeguard that no procurement contract could come into force while the review proceedings continued.
ومن هذا المنظور، أُوضح أنَّ الإيقاف لن يكون لازماً إلا في ظروف استثنائية، وشريطة ألا يبدأ نفاذ أيِّ عقد اشتراء ما دامت إجراءات إعادة النظر مستمرة.

It was proposed that the paragraph should be revised to provide for the possibility that more than one procurement contract might result from procurement proceedings.
268- اقتُرح تنقيح هذه الفقرة بحيث تنص على إمكانية تمخض إجراءات الاشتراء عن أكثر من عقد اشتراء واحد.

A framework agreement is not a procurement contract within the meaning of article 2 (g) of this Law.
والاتفاق الإطاري ليس عقد اشتراء بالمعنى الوارد في الفقرة 2 (ز) من هذا القانون.

(4) The procuring entity shall award any procurement contract on the basis of the terms and conditions of the framework agreement, and in accordance with the following procedures:

It was observed that a procurement contract that had been properly concluded, i.e. following the applicable procedures including review procedures where relevant, should not be annulled.
46- وذُكر أنه لا ينبغي إلغاء أي عقد اشتراء كان أُبرم بصورة صحيحة، أي حسب الإجراءات المعمول بها، بما فيها إجراءات إعادة النظر حيثما انطبقت.

The issue was considered relevant not only throughout the conduct of ERAs, but in procurement systems in general, and it was agreed that it would be vital not only to allow suppliers to have effective recourse after the event, but also to provide recourse prior to any award of the procurement contract.

(e) " supplier or contractor " means, according to the context, any potential party or the party to a procurement contract with the procuring entity;
