The Convention aims to facilitate application to existing investment treaties of the UNCITRAL Rules on Transparency in Treaty-based Investor-State Arbitration adopted in 2013.

It was further said that such an approach would create confusion and legal uncertainty and that the Working Group should rather focus on drafting an instrument to be adopted by States aimed at ensuring that the legal standard on transparency would apply to existing investment treaties.

In that light, it was pointed out that the different options to make the legal standard applicable to existing investment treaties were laid out in document A/CN.9/WG.II/WP.162.

The Commission agreed to include in its decision adopting the rules on transparency a recommendation urging parties to investment treaties to apply the standard to existing investment treaties.
114- ووافقت اللجنة على تضمين مقررها الذي تعتمد بموجبه قواعد الشفافية توصية تحث أطراف معاهدات الاستثمار على تطبيق هذا المعيار على معاهدات الاستثمار القائمة.

Further to previous discussions of the Working Group, the Commission may wish to consider a recommendation urging Parties to investment treaties to apply the standard to existing investment treaties.
19- لعلّ اللجنة تود، وفقا للمناقشات السابقة التي أجراها الفريق العامل،() أن تنظر في وضع توصية تحُث أطراف معاهدات الاستثمار على تطبيق المعيار على معاهدات الاستثمار القائمة.

In order to reconcile the views expressed in relation to the inclusion of a temporal limitation in the application of the transparency convention, it was proposed to delete the temporal limitation but to include a reservation allowing Contracting Parties to limit the scope of application of the transparency convention to existing investment treaties.
57- وبغية التوفيق بين الآراء التي أُعرِب عنها فيما يتعلق بإدراج قيد زمني في تطبيق اتفاقية الشفافية، اقتُرِحَ حذف القيد الزمني على أن يُدرَجَ تحفُّظٌ يتيح للأطراف المتعاقدة الاقتصار في نطاق تطبيق اتفاقية الشفافية على معاهدات الاستثمار القائمة.

According to speakers, the important work of UNCITRAL should therefore continue: UNCITRAL should not only soon prepare a convention devising a mechanism for applicability of the Rules to existing investment treaties but also take steps towards practical implementation of the Rules, collection and dissemination of the relevant information as required under the Rules and promotion of good practices with respect to the use of the Rules.
ولذلك ينبغي، وفقًا للمتكلمين، أن تواصل الأونسيترال ما تقوم به من عمل هام: إذ لا ينبغي لعملها أن يقتصر على الإسراع بالانتهاء من إعداد اتفاقية لاستحداث آلية لتطبيق القواعد على معاهدات الاستثمار القائمة فحسب، بل عليها أيضا أن تتخذ خطوات نحو تنفيذ القواعد عملياً، وجمع المعلومات ذات الصلة ونشرها، حسبما تقتضيه القواعد وتعزيز الممارسات الجيدة فيما يتعلق باستخدام القواعد.

Mr. Zemet (Israel), observing that 2013 had been a particularly productive year for UNCITRAL, said that the good compromise achieved with regard to the application of the Rules on Transparency in Treaty-based Investor-State Arbitration to existing investment treaties reflected the collaborative spirit that prevailed in the Commission.

The possibility of making the rules on transparency applicable to existing investment treaties by joint interpretative declaration pursuant to article 31(3)(a) of the Vienna Convention on the Law of Treaties (the " Vienna Convention " ), or by an amendment or modification of a relevant treaty pursuant to articles 39-41 of the Vienna Convention, was also considered by the Working Group.
كما نظر الفريق العامل في إمكانية تطبيق قواعد الشفافية على معاهدات الاستثمار القائمة بمقتضى إعلان تفسيري مشترك يصدر وفقا للمادة 31 (3) (أ) من اتفاقية فيينا لقانون المعاهدات ( " اتفاقية فيينا " )، أو من خلال تعديل أو تغيير المعاهدة ذات الصلة عملا بالمواد من 39 إلى 41 من اتفاقية فيينا.

كما أحاطت اللجنة علماً بإمكانية جعل قواعد الشفافية قابلة للتطبيق على معاهدات الاستثمار القائمة بمقتضى إعلان تفسيري مشترك يصدر وفقاً للفقرة (3) (أ) من المادة 31 من اتفاقية فيينا لقانون المعاهدات، أو من خلال إدخال تعديل أو تغيير في المعاهدة ذات الصلة عملا بالمواد من 39 إلى 41 من تلك الاتفاقية (A/CN.9/784).
