The Commercial Code authorizes a minor to head a commercial enterprise and acquire the legal status of trader, provided that he is emancipated, or empowered or authorized (de facto emancipation), and a minor who does not satisfy any of these requirements or is incapable by reason of age or failure to meet other natural conditions may become a trader by inheritance or donation of a commercial enterprise.
125- ويأذن القانون التجاري للقاصر بامتلاك مؤسسة تجارية أو اكتساب المركز القانوني للتاجر، إذا كان يعول نفسه أو مؤهلاً أو مأذوناً له (عائل نفسه بحكم الواقع)، والذين لا يستوفون أياً من هذه الشروط ويكونون غير أهل بسبب السن أو لافتقارهم إلى شروط طبيعية أخرى، يجوز لهم أن يصبحوا تجاراً إذا حصلوا على مؤسسة تجارية عن طريق الميراث أو الهبة.
