وفي الحالات التي يتعذر فيها التنفيذ، يرسل الشخص إلى عهدة الدولة ويودع في مرفق إقامة.

Placement in an accommodation facility constitutes deprivation of liberty to the extent that such a facility is enclosed and specially fitted out and managed by the Romanian immigration authorities for the temporary housing of aliens assigned to the custody of the State.
ويشكل الإيداع في مرفق إقامة سلبا للحرية لأن مثل هذا المرفق مسيّج ومجهز على نحو خاص، وتديره سلطات الهجرة الرومانية المعنية بالمساكن المؤقتة للأجانب الموضوعين في عهدة الدولة.

The Committee also expresses its concern about the legislation in force in the State party which allows the parents of a newborn boy or girl to place him/her in the custody of the State solely on the basis of his/her disability, without taking into account the best interests of the child.
38- وتبدي اللجنة قلقها أيضاً إزاء القانون الساري المفعول في الدولة الطرف والذي يسمح لوالدي وليد، أكان ذكراً أم أنثى، في عهدة الدولة بسبب إعاقته فقط، دون مراعاة مصالح الطفل الفضلى.

3. Juvenile offenders admitted to corrective or rehabilitative institutions, and juveniles who become wards of the State or who are placed in public or private orphanages, shall be kept separately from adults.
٣- المجرمون الأحداث الذين يودعون في مؤسسات الإصلاح أو إعادة التأهيل، والأحداث الذين يوضعون في عهدة الدولة أو يودعون في دور الأيتام العامة أو الخاصة، يتم عزلهم عن الكبار.

The Committee recommends that the State party prohibit the placement by their fathers and mothers of newborn boys and girls with disabilities in the custody of the State solely on the basis of their disability.
39- توصي اللجنة بأن تحظر الدولة الطرف وضع الآباء والأمهات المواليد الجدُد من الذكور والإناث ذوي الإعاقة في عهدة الدولة بسبب إعاقتهم فقط.

(b) The State to which the person is transferred shall without delay implement its obligation to return the person to the custody of the State from which the person was transferred as agreed beforehand, or as otherwise agreed, by the competent authorities of both States;
