5. Urges States parties to withdraw reservations that are incompatible with the object and purpose of the Convention or the Optional Protocols thereto and to consider reviewing regularly other reservations with a view to withdrawing them, in accordance with the Vienna Declaration and Programme of Action;

5. Urges States parties to withdraw reservations that are incompatible with the object and purpose of the Convention or the Optional Protocols thereto and to consider reviewing regularly other reservations with a view to withdrawing them in accordance with the Vienna Declaration and Programme of Action;10

182. It must in any case be acknowledged that the travaux préparatoires for subparagraph (c) are confused and do not provide any clearer indications of any consequences that the drafters of the Convention intended to draw from the incompatibility of a reservation with the object and purpose of the Convention:
182- وأيا كان الأمر فإنه يجدر بالإقرار أن الأعمال التحضيرية المتعلقة بالفقرة الفرعية (ج) غامضة ولا تورد الكثير من الإشارات الواضحة بشأن النتائج التي كان واضعو الاتفاقية ينوون ترتيبها على عدم توافق تحفظ مع غرض الاتفاقية ومقصدها():

1. Urges once again the States that have not yet done so to consider signing and ratifying or acceding to the Convention on the Rights of the Child as a matter of priority and, concerned at the great number of reservations to the Convention, urges States parties to withdraw reservations incompatible with the object and purpose of the Convention and to consider reviewing other reservations with a view to withdrawing them;
1- تحث مرة أخرى الدول التي لم تقم بعد بالتوقيع على اتفاقية حقوق الطفل أو التصديق عليها أو الانضمام إليها على القيام بذلك على سبيل الأولوية، وإذ تشعر بالقلق إزاء العدد الكبير من التحفظات المبداة على الاتفاقية، تحث الدول الأطراف على سحب التحفظات التي لا تتمشى مع غرض الاتفاقية ومقصدها وعلى التفكير في إعادة النظر في التحفظات الأخرى بغية سحبها؛

2. 2- تحث مرة أخرى الدول التي لم تقم بعد بالتوقيع على اتفاقية حقوق الطفل أو التصديق عليها أو الانضمام إليها على القيام بذلك على سبيل الأولوية، وإذ تشعر بالقلق إزاء العدد الكبير من التحفظات المبداة على الاتفاقية، تحث الدول الأطراف على سحب التحفظات التي لا تتماشى مع غرض الاتفاقية ومقصدها وعلى التفكير في إعادة النظر في التحفظات الأخرى بغية سحبها؛

In the first place, there can be no doubt that the human rights treaty bodies are competent to rule on the validity of a reservation, when the issue comes before them in the exercise of their functions, including of course the compatibility of the reservation with the object and purpose of the treaty.
فأولا، ليس ثمة شك في أن هيئات حقوق الإنسان، عندما تعرض عليها القضايا، في إطار ممارستها لاختصاصاتها، تكون مختصة بالبت في مسألة صحة تحفظ من التحفظات، بما في ذلك بطبيعة الحال توافقه مع غرض الاتفاقية ومقصدها().
