In addition, under article 163 of the Criminal Code it is a crime for a public official to arrest, imprison or detain any person in circumstances other than those provided for by law. Such an act carries a penalty of up to 5 years' imprisonment.
وأيضاً جرم قانون العقوبات في المادة 163 قيام الموظف العام بالقبض على شخص أو حبسه أو حجزه في غير الأحوال المقررة في القانون، وهذا الفعل معاقب عليه بعقوبة الحبس مدة لا تتجاوز خمس سنوات.

The articles specify the penalties to be applied in the case of any public servant who tortures an accused person, instructs that a sentenced person be punished by a harsher penalty than that passed by a court, or enters the residence of any person without his consent in circumstances other than those specified by law.
وتنص هذه المواد على معاقبة كل موظف عام أو مستخدم قام بتعذيب متهم أو شاهد أو أمر بعقاب المحكوم عليه بأشد من العقوبة المحكوم بها عليه قانوناً أو دخل مسكن أحد الأفراد بغير رضائه في غير الأحوال التي بينها القانون بعقوبات حددتها تلك المواد.

Elsewhere, article 122 of the Penal Code punishes any public officer who enters the residence of any person without his consent, or in circumstances other than those specified by law, with a term of imprisonment of no more than three years and/or a fine not exceeding 3,000 rupees.
وبالاضافة إلى ذلك عاقبت المادة 122 من قانون الجزاء كل موظف عام دخل مسكن أحد الأفراد دون رضائه في غير الأحوال التي يحددها القانون بالحبس مدة لا تتجاوز ثلاث سنوات وبغرامة لا تتجاوز ثلاثة آلاف روبية أو بإحدى هاتين العقوبتين.

Article 249: Criminal proceedings against the perpetrator of an offence or of an act carried out abroad may only be brought by the Department of Public Prosecutions. In cases other than those specified in article 247, proceedings must be preceded by a complaint lodged by the injured party in accordance with article 27 or by an official notification from the authorities of the foreign State in which the offence was committed.
المادة 249: لا تقام الدعوى الجزائية على مرتكب جريمة أو فعل وقع في الخارج إلا من النيابة العامة وفي غير الأحوال المنصوص عليها في المادة 247 يجب أن يسبقها شكوى المضرور في الأحوال المنصوص عليها في المادة 27 أو إبلاغ رسمي من السلطات الأجنبية التي وقعت الجريمة في إقليمها.

(c) Owning, possessing, acquiring, buying, selling, handing over, transporting or offering a narcotic drug for consumption and with a view to dealing in the substance by any means not permitted under this Act;
(ج) كل من تملك أو حاز أو أحرز أو اشترى أو باع أو سلم أو نقل أو قدم للتعاطي مادة مخدرة وكان ذلك بقصد الاتجار فيها بأية صورة وذلك في غير الأحوال المصرح بها في هذا القانون؛

Anyone who possesses, acquires, purchases, sells, delivers, receives or traffics in narcotic substances or plants listed in Schedule No. 4, or who cedes them, acts as an intermediary therein or offers them for consumption with a view to trafficking therein, in an illicit manner;
`1` كل من حاز أو أحرز أو اشترى أو باع أو سلم أو تسلم مواد مخدرة أو نبات من النباتات البينة في الجدول رقم 4 أو تنازل عليها أو توسط فيها أو قدمها للتعاطي وكان كذلك بقصد الاتجار أو اتجر فيها في غير الأحوال المرخص بها في هذا القانون؛

" The inviolability of the private life of a citizen may not be breached in circumstances other than those permitted under this Code. The commission of any of the following acts shall be deemed to constitute a breach thereof:
- " لا يجوز المساس بحرية الحياة الخاصة للمواطن في غير الأحوال المصرح بها في هذا القانون، ويعتبر مساساً بها ارتكاب أحد الأفعال الآتية:

(c) No citizen may be arrested, searched, detained, placed under surveillance or deprived of his liberty in circumstances other than those defined by law;
(ج) مبدأ حظر القبض، والتفتيش، والحجز، والمراقبة، وتقييد حرية المواطنين في غير الأحوال التي يحددها القانون؛

- Anyone who arrests, imprisons or confines a person in circumstances other than those prescribed by law or without observing the procedures thus prescribed shall be punished by a term of up to three years' imprisonment and/or a fine of 3,000 rupees.
- كل من قبض على شخص أو حبسه أو حجزه في غير الأحوال التي يقرها القانون، أو بغير مراعاة للإجراءات التي يقررها، يعاقب بالحبس مدة لا تجاوز ثلاث سنوات وبغـرامة لا تتجاوز ثلاثــة آلاف روبية أو بإحدى هاتين العقوبتين.

In all cases, the official in question shall be removed from his post. " Article 169 of the Penal Code stipulates a maximum penalty of three years' imprisonment for any public official who knowingly searches a person, his home or premises without that person's consent or under circumstances other than those prescribed by law.
89- وتنص المادة 169 على أن يعاقب بالحبس لمدة لا تزيد على ثلاث سنوات كل موظف عام أجرى تفتيش شخص أو سكنه أو محله بغير رضاه أو في غير الأحوال أو دون مراعاة الشروط التي ينص عليها القانون، مع علمه بذلك.

According to article 14 of the Code of Criminal Procedure: " The inviolability of a citizen's private life may not be infringed in circumstances other than those prescribed by this Code. The commission of any one of the following acts shall be deemed an infringement thereof:
95- وتنص المادة 14 على أنه " لا يجوز المساس بحرمة الحياة الخاصة للمواطن في غير الأحوال المصرح بها في هذا القانون، ويعتبر ارتكاب أحد الأفعال التالية مساساً بها:

In circumstances other than those specified in articles 9, 10 and 11, the provisions of this Code are applicable to any person who enters Iraq after committing abroad, in the capacity of principal or accomplice, any of the following offences:
" في غير الأحوال المنصوص عليها في المواد 9 و10 و11 تسري أحكام هذا القانون على كل من وجد في العراق بعد أن ارتكب في الخارج بوصفه فاعلاً أو شريكاً جريمة من الجرائم التالية:

" In circumstances other than those stipulated in articles 9, 10 and 11, the provisions of this Code are applicable to all those who enter Iraq subsequent to committing an offence abroad, whether as perpetrators or accomplices in the following offences:
" في غير الأحوال المنصوص عليها في المواد 9 و10 و11 تسري أحكام هذا القانون على كل من وجد في العراق بعد أن ارتكب في الخارج بوصفه فاعلاً أو شريكاً جريمة من الجرائم التالية:

54. In addition, under article 163 of the Criminal Code it is a crime for a public official to arrest, imprison or detain any person in circumstances other than those provided for by law. Such an act carries a penalty of up to 5 years' imprisonment.
54- وأيضاً جرم قانون العقوبات في المادة 163 قيام الموظف العام بالقبض على شخص أو حبسه أو حجزه في غير الأحوال المقررة في القانون، وهذا الفعل معاقب عليه بعقوبة الحبس مدة لا تتجاوز خمس سنوات.

For example, article 184 of the Criminal Code No. 16/1960, as amended, provides that anyone who arrests, imprisons or detains a person in circumstances other than those prescribed by law, or who fails to respect the rules of due process of law, shall be liable to a penalty of up to three years in prison and/or a fine of up to 3,000 dinars.
فمثلا، تنص المادة 184 من قانون الجزاءات رقم 16/1960 وتعديلاته، على معاقبة كل من قبض على شخص أو حبسه أو حجزه في غير الأحوال التي يقرها القانون، أو بغير مراعاة الإجراءات التي يقررها، بالحبس مدة لا تتجاوز ثلاث سنوات وبغرامة لا تتجاوز 000 3 دينار، أو بإحدى هاتين العقوبتين.

317. In the framework of these constitutional provisions the drafters of the Egyptian Penal Code, in article 280 thereof, stipulate that it is a criminal offence to arrest or detain any person without an order from the competent authorities or in circumstances other than those in which such is permitted by law.
318- في إطـار هـذه النصـوص الدستورية، أتمّ المشرّع العقابي المصري بالمـادة 280 عقوبات فعل القبض على أي شخص أو احتجازه أو حبسه بدون أمر الحكام المختصين وفي غير الأحوال المصرح بها قانوناً، وجعل عقوبة ذلك الحبس أو الغرامة.

Article 253 states: " A term of up to one year's imprisonment or a fine shall be imposed on anyone who, against the wishes of the owner and in circumstances other than those provided for by law, enters a place that is inhabited or intended for habitation or an annex thereof or any place intended for keeping money or property, and similarly on anyone who remains there against the wishes of a person who has the right to remove him.
وجاء في المادة 253: " يعاقب بالحبس مدة لا تزيد على سنة أو بالغرامة من دخل مكاناً مسكوناً أو معداً للسكن أو أحد ملحقاته أو أي محل معداً لحفظ المال أو عقاراً خلافاً لإرادة صاحب الشأن وفي غير الأحوال المبينة في القانون وكذلك من بقي فيه خلافاً لإرادة من له الحق في إخراجه.

117. Article 258 also stipulates: " A term of up to one year's imprisonment or a fine shall be imposed on anyone who, by virtue of his occupation, trade or position, holds confidential information that he discloses in circumstances other than those permitted by law or that he uses to benefit himself or another person, unless he was authorized to disclose or use that information by its owner.
117- كما تنص المادة 258: يعاقب بالحبس مدة لا تزيد على سنة أو بالغرامة من كان بحكم مهنته أو حرفته أو وضعه مستودع سر فأفشاه في غير الأحوال المصرح بها قانوناً أو استعمله لمنفعته أو لمنعه شخص آخر ما لم يأذن صاحب الشأن في السر بإفشائه أو استعماله.

52. Under the provisions of article 322 of the Penal Code: " Any public official or agent who arrests, imprisons or detains a person in circumstances other than those prescribed by law shall be liable to a term of up to seven years' imprisonment. "
52- كما نصت المادة 322 من قانون العقوبات على أن " يعاقب بالسجن مدة لا تزيد على سبع سنوات أو بالحبس كل موظف أو مكلف بخدمة عامة قبض على شخص أو حبسه أو حجزه في غير الأحوال التي ينص عليها القانون " .

Article 13 of the Law provides that in cases other than those provided for in articles 9, 10 and 11, its provisions apply to anyone who is in Iraq after having committed, outside Iraq, as principal or accomplice, any of the following offences: sabotage or damaging of international or State communications or intelligence media or trafficking in women, children, slaves or drugs.
نصَّت المادة 13 على أنه: " في غير الأحوال المنصوص عليها في المواد 9 و 10 و 11 تسري أحكام هذا القانون على كل من وُجد في العراق بعد أن ارتكب في الخارج بوصفه فاعلا أو شريكا جريمة من الجرائم التالية: تخريب أو تعطيل وسائل المخابرات والمواصلات الدولية والاتجار بالنساء أو بالصغار أو بالرقيق أو بالمخدرات " .

(d) Cultivating any of the plants listed in Table 1 or importing, exporting, possessing, acquiring, buying, selling, handing over or transporting such plants in any stage of growth, including in seed form, for the purpose of dealing in them in any way and by any means not permitted under this Act;
(د) كل من زرع نباتاً من النباتات الواردة في الجدول رقم 1 أو صدر أو جلب أو حاز أو أحرز أو اشترى أو باع أو سلم أو نقل نباتاً من هذه النباتات في أي طور من أطوار نموها هي أو بذورها وكان ذلك بقصد الاتجار أو اتجر فيها بأية صورة وذلك في غير الأحوال المصرح بها في هذا القانون؛
