However, a standstill period between selection of the supplier and award of the contract could be used to ascertain whether the procedures had been followed, prior to the expiry of which the procurement contract would not come into force.
بيد أنه يمكن استخدام فترة التوقّف بين انتقاء المورّد وإرساء العقد، التي لن يبدأ نفاذ عقد الاشتراء قبل انقضائها، للتأكّد مما إذا كانت الإجراءات قد اتُّبعت.

In such a case, the notice is dispatched by the procuring entity promptly upon the expiry of the standstill period.
وفي هذه الحالة ترسل الجهة المشترية الإشعار فور انقضاء فترة التوقّف.

Second, the standstill period was applied and a challenge or appeal is still outstanding upon the expiry of the standstill period.
وثانياً، تطبّق فترة التوقّف ويظلّ الاعتراض أو الاستئناف معلّقا عند انقضاء فترة التوقّف.

The length of the standstill period may appropriately be reflected in working or calendar days, depending on the length and likely intervention of non-working days.
ولعل من المناسب التعبير عن طول فترة التوقّف بأيام العمل أو الأيام التقويمية تبعاً لطول أيام العطل واحتمال وقوعها أثناء فترة التوقّف.

It should be borne in mind that the primary aim of the standstill period is to allow suppliers or contractors sufficient time to decide whether to challenge the procuring entity's intended decision to accept the successful submission.
وينبغي ألاّ يغيب عن البال أنَّ الهدف الرئيسي من فترة التوقّف هو إتاحة الوقت الكافي للمورِّدين أو المقاولين للبتّ في مسألة تقديم اعتراض على القرار الذي تعتزم الجهة المشترية اتخاذه بقبول العرض الفائز.

It was underscored that the standstill period would be an important tool in the fight against corruption in that it would facilitate a credible and effective system by permitting reviews before the entry into force of the contract.
ومن المفهوم أن فترة التوقّف ستكون أداة هامة في مكافحة الفساد، لأنها تُيسّر وجود نظام ذي مصداقية وفعّال إذ تتيح إجراء المراجعات قبل بدء نفاذ العقد.

It was stressed that it was essential for suppliers or contractors participating in the procurement to receive sufficient information about the evaluation process to make the meaningful use of the standstill period.
وشُدّد على أن من الضروري أن يتلقى المورّدون أو المقاولون المشاركون في الاشتراء ما يكفي من المعلومات عن عملية التقييم لكي يستخدموا فترة التوقّف استخداما مفيدا.

Another view was that the date of receipt should be the relevant date, because the standstill period should reflect the time available to the recipient to consider whether to lodge a request for review, and that some systems operated on this principle.
وذهب رأي آخر إلى أن تاريخ الاستلام هو التاريخ المناسب، لأنه ينبغي أن تراعي فترة التوقّف الوقت المتاح لمستلم الإشعار لكي ينظر فيما إذا كان سيقدّم طلب إعادة نظر، وأن بعض النظم تعمل استناداً إلى هذا المبدأ.

The understanding was that the procuring entity should then have flexibility in determining the exact duration of the standstill period appropriate for each procurement, subject to that statutory minimum.
وكان مفهوما أنه ينبغي أن يتاح للجهة المشترية قدر من الحرية في تحديد مدة فترة التوقّف المناسبة لكل عملية اشتراء، رهنا بذلك الحد الأدنى المنصوص عليه قانوناً.

It was noted that the appropriate duration of the standstill period would depend to a considerable extent upon the main means of communications used and whether procurement was domestic or international.
وذُكر أن مدة فترة التوقّف المناسبة سوف تتوقّف إلى حد بعيد على وسيلة الاتصال الرئيسية المستخدمة وعلى ما إذا كانت عملية الاشتراء محلية أم دولية.

It was further commented that the possibility of annulment would be a necessary complement to the introduction of an effective " Alcatel standstill " period, to avoid procuring entities from permitting the standstill period to elapse without further action.
54- وأُبدي تعليق آخر مفاده أن إتاحة إمكانية الإلغاء ستكون عنصرا ضروريا مكملاً للأخذ بفترة توقف " Alcatel standstill " فعّالة، منعا لأن تسمح الجهات المشترية بانقضاء فترة التوقّف دون فعل آخر.

It was considered that the guide should explain the impact that the duration of the standstill period would have on overall objectives of the revised model law as regards transparency, accountability, efficiency and equitable treatment of suppliers or contractors.
238- ورئي أنه ينبغي أن يوضح الدليل أثر مدة فترة التوقّف على أهداف القانون النموذجي المنقّح فيما يتعلق بالشفافية والمساءلة والفعالية ومعاملة المورّدين أو المقاولين على قدم المساواة.

The primary purpose of the standstill period is therefore to provide an opportunity to rectify any improprieties discovered prior to the entry into force of the procurement contract or the conclusion of the framework agreement, and thus to avoid the need for an annulment of a contract or framework agreement that has entered into force.
ولذا فإنَّ الغرض الرئيسي المتوخَّى من فترة التوقّف هو إتاحة فرصة لتصحيح أيِّ تصرّفات غير سليمة قبل بدء نفاذ عقد الاشتراء أو إبرام الاتفاق الإطاري، ومن ثَمَّ تجنّب الحاجة إلى إلغاء العقد أو الاتفاق الإطاري الذي دخل حيّز النفاذ.

Such a standstill period, it was noted, might avoid the need for any annulment as errors could be possibly corrected prior to the conclusion of the procurement contract, and it could also avoid the complication of having to set aside an executed procurement contract.
وذكر أن فترة التوقّف هذه قد تبطل الحاجة إلى أي إلغاء، لأنه يمكن تصحيح الأخطاء قبل إبرام عقد الاشتراء، كما يمكنها أن تحول دون التعقيدات المتمثلة في ضرورة فسخ عقد اشتراء مُبرَم.

The Working Group considered other cases that would justify exemptions from the application of a standstill period.
136- ونظر الفريق العامل في حالات أخرى تبرّر الاستثناء من تطبيق فترة التوقّف.

The other view was that it would be better for provisions suggested for reinstatement to be reflected in the guide, as such provisions were closely connected to the administrative review systems of each enacting State that would determine when a standstill period should start.
وذهب الرأي الآخر إلى أن الأحكام المقترح إعادة إدراجها يفضَّل أن ترد في الدليل، لأن تلك الأحكام وثيقة الارتباط بنظم إعادة النظر الإدارية الخاصة بكل دولة مشترعة والتي تحدّد وقت بدء سريان فترة التوقّف.
