8- وتصدر الحكومة عفواً عاماً عن الأطفال الذين شاركوا في أعمال حربية ثم عادوا أو فروا في وقت لاحق.

]تتخذ الدول اﻷطراف جميع التدابير الملائمة لمنع تجنيد اﻷشخاص الذين لم يبلغوا الثامنة عشرة من عمرهم من جانب جماعات مسلحة غير حكومية متورطة في أعمال حربية.[

٣٤- وأحاطت لجنة حقوق الطفل علماً مع الاهتمام بالمقترح المقدم في الفريق العامل بشأن دور اللجنة في النظر في الحالات التي كان سيتم فيها تجنيد أطفال خاضعين لولاية دولة طرف أو استخدامهم في أعمال حربية.

11. Through the provisions of the Constitution, Panama clearly observes the rules of international law calling for special protection of children involved in hostilities or armed conflicts.
١١- ومن الجلي أن بنما تراعي، من خلال أحكام الدستور، المعايير الدولية لحقوق اﻹنسان الداعية إلى توفير حماية خاصة لﻷطفال المشتركين في أعمال حربية أو نزاعات مسلحة.

The Committee notes with appreciation the information provided by the State party during the dialogue to the effect that it assumes extraterritorial jurisdiction in cases of the forced recruitment or participation in hostilities of children.
11- وتلاحظ اللجنة مع التقدير المعلومات التي قدمتها الدولة الطرف أثناء الحوار ومفادها أنها تمارس ولايتها القضائية خارج حدودها الإقليمية في حالات التجنيد القسري للأطفال أو إشراكهم في أعمال حربية.

The Committee notes there may be unaccompanied migrant children or children migrating with their families who do not necessarily seek asylum, but may have been involved in hostilities abroad.
12- تلاحظ اللجنة أنه قد يكون هناك أطفال مهاجرون غير مصحوبين أو أطفال مهاجرون مع أسرهم لا يلتمسون اللجوء بالضرورة، لكنهم قد يكونون أيضاً قد أُشركوا في أعمال حربية في الخارج.

289. The Committee requests that the State party provide information in its next report on refugee and migrant children within its jurisdiction that may have been involved in hostilities in their home country and the assistance provided for their physical and psychological recovery and their social reintegration.
289- تطلب اللجنة إلى الدولة الطرف أن تقدم في تقريرها التالي معلومات عن الأطفال اللاجئين والمهاجرين الخاضعين لولايتها والذين يمكن أن يكونوا قد شاركوا في أعمال حربية في بلدان منشئهم، وعن المساعدة المقدمة من أجل تأمين تعافيهم البدني والنفسي وإعادة إدماجهم اجتماعياً.

8. The Committee regrets that the State party does not collect data on the number of refugee children, accompanied or unaccompanied, nor on the number of these children present in the jurisdiction of the State party who have been recruited or used in hostilities.
8- تأسف اللجنة لعدم قيام الدولة الطرف بجمع بيانات عن عدد الأطفال اللاجئين، المصحوبين أو غير المصحوبين، ولا عن عدد هؤلاء الأطفال الخاضعين لولايتها الذين تم تجنيدهم أو استخدامهم في أعمال حربية.

The Committee recommends that the State party explicitly prohibit and criminalize the recruitment or use in hostilities of children under the age of 18 in the Armed Forces of the State party and in non-State armed groups.
28- توصي اللجنة بأن تحظر الدولة الطرف وتجرّم صراحةً تجنيد الأطفال دون سن 18 سنة أو استخدامهم في أعمال حربية في كل من قوات الدولة الطرف المسلحة والجماعات المسلحة غير التابعة للدولة.

However, the articles in question would not appear to meet the requirements of the resolution as far as it concerns the recruitment of mercenaries for the purpose of participating in military action against a foreign State.
غير أنه يبدو أن هذه المادة لا تستوفي متطلبات القرار، نظرا لأنها تتعلق بتجنيد مرتزقة من أجل المشاركة في أعمال حربية ضد دولة أجنبية.

Under the new offence, assisting those engaged in armed hostilities with the Australian Defence Force constitutes treason even if those others are an organisation rather than another country, and even if there is no formally declared war.
