المادة ٥٢: حق الفرد في أن يشارك في إدارة الشؤون العامة وحقه في أن تتاح له على قدم المساواة فرصة تقلد الوظائف العامة

The Committee recalls that article 25 of the Covenant recognizes and protects the right of every citizen to take part in the conduct of public affairs, the right to vote and to be elected and the right to have access to public service.
وتذكّر اللجنة بأن المادة 25 من العهد تُقر وتحمي حق كل مواطن في أن يشارك في إدارة الشؤون العامة، وحقه في أن ينتخب ويُنتخَب، وحقه في تقلّد الوظائف العامة.

167. In accordance with article 25 of the International Covenant on Civil and Political Rights, every citizen, without any distinction and without unreasonable restrictions, has the right to take part in the conduct of public affairs, directly or through freely chosen representatives, as well as the right to vote and to be elected.
١٦٧ - عملا بالمادة ٢٥ من العهد الدولي الخاص بالحقوق المدنية والسياسية فإن لكل مواطن، دون أي وجه من وجوه التمييز ودون قيود غير معقولة، الحق في أن يشارك في إدارة الشؤون العامة إما مباشرة وإما بواسطة ممثلين يختارون في حرية فضلا عن الحق في أن ينتخب وينتخب.

3- تنص المادة 25 من العهد الدولي الخاص بالحقوق المدنية والسياسية على إقرار وحماية حق كل مواطن في أن يشارك في إدارة الشؤون العامة، والحق في أن يَنتخب ويُنتخب، وأن تتاح له فرصة تقلد الوظائف العامة.

Article 25 of the International Covenant on Civil and Political Rights guarantees the right of every citizen, without any of the distinctions mentioned in article 2 of the Covenant, to take part in the conduct of public affairs, to vote and to be elected at genuine periodic elections, and to have access to public service.
أما المادة 25 من العهد الدولي الخاص بالحقوق المدنية والسياسية فتضمن حق كل مواطن، دون أي تمييز من أوجه التمييز المشار إليها في المادة 2 من العهد في أن يشارك في إدارة الشؤون العامة، وفي أن يَنتخِب ويُنتخَب في انتخابات دورية نزيهة، وفي أن تتاح له فرصة تقلد الوظائف العامة(4).

Reaffirming that every citizen shall have the right and the opportunity, without any of the distinctions stipulated in the International Covenant on Civil and Political Rights and without unreasonable restrictions, to take part in the conduct of political and public affairs, directly or through freely chosen representatives, and to have access, on general terms of equality, to public service in his or her country,
وإذ يؤكد من جديد أن لكل مواطن الحق والفرصة في أن يشارك في إدارة الشأن السياسي والعام، مباشرة أو بواسطة ممثلين يُختارون بحرية، وأن تتاح له، على قدم المساواة عموماً مع سواه، فرصة تقلد الوظائف العامة في بلده، دون أي شكل من أشكال التمييز المنصوص عليها في العهد الدولي الخاص بالحقوق المدنية والسياسية ودون قيود غير معقولة،

It follows, therefore, that if this part of the electoral process is encompassed within the right to free participation in elections, then it is equally protected by the guarantees of article 25 of the Covenant, which recognizes and protects the right of every citizen to take part in the conduct of public affairs, the right to vote and to be elected and the right to have access to public service.
وعليه، فإن ذلك يستتبع أنه إذا كان هذا الجزء من العملية الانتخابية مشمول بالحق في المشاركة الحرة في الانتخابات، فإنه يكون حينها محمياً على قدم المساواة بالضمانات المحددة في المادة 25 من العهد، التي تعترف بحق كل مواطن في أن يشارك في إدارة الشؤون العامة وبحقه في التصويت وبحقه في أن يُنتخب وبحقه في الوصول إلى الخدمة العامة، والتي تحمي هذه الحقوق.

5- تقضي المادة 25 من العهد الدولي الخاص بالحقوق المدنية والسياسية بحق كل مواطن في أن يشارك في إدارة الشؤون العامة، وفي أن يَنتخب ويُنتخب، وأن تتاح له فرصة تقلُّد الوظائف العامة().

Article 25 of the International Covenant on Civil and Political Rights, as well as the interpretive General Comment and jurisprudence adopted by the Human Rights Committee, define the obligations of States parties in connection with the right to take part in the conduct of public affairs, vote and be elected at genuine periodic elections, and have equal access to public service positions.
7- وتُحدَّد في المادة 25 من العهد الدولي الخاص بالحقوق المدنية والسياسية وفي التعليق العام التفسيري والاجتهادات التي اعتمدتها اللجنة المعنية بحقوق الإنسان التزامات الدول الأطرف فيما يتعلق بحق الفرد في أن يشارك في إدارة الشؤون العامة وفي أن يَنتخب ويُنتخب في انتخابات دورية نزيهة، وأن تتاح له فرصة تقلد الوظائف العامة على قدم المساواة بين الجميع.
