In the light of its general recommendation No. 31 (2005) on the prevention of racial discrimination in the administration and functioning of the criminal justice system, the Committee urges the State party in its national legal system to recognize the indigenous legal system and to ensure respect for, and recognition of, the traditional systems of justice of indigenous peoples, in conformity with international human rights law.
تناشد اللجنة الدولة الطرف، في ضوء توصيتها العامة رقم 31 المعتمَدة في عام 2005 بشأن منع التمييز العنصري في إدارة وسير عمل القضاء الجنائي، أن تدمج النظام القانوني للشعوب الأصلية في النظام القانوني الوطني، وأن تحترم نُظُم العدالة التقليدية للشعوب الأصلية، وفقاً للمعايير الدولية لحقوق الإنسان.

Reiterating the importance of statistical data on the ethnicity of persons held in prison or preventive detention for assessing the existence or extent of racial discrimination in the administration and functioning of the criminal justice system, the Committee recommends that data on the ethnicity of persons in preventive detention be collected at the same time as other demographic information.
إذ تؤكد اللجنة على أهمية البيانات الإحصائية بشأن إثنية المحتجزين في السجون أو الموقوفين رهن المحاكمة لتقييم وجود التمييز العنصري أو نطاقه في إدارة وسير عمل نظام العدالة الجنائية، توصي الدولة الطرف بجمع بيانات بشأن إثنية الأشخاص المحتجزين رهن المحاكمة بالتزامن مع جمع المعلومات الديمغرافية الأخرى.
