1. The workshop on the impact of the application of unilateral coercive measures on the enjoyment of human rights by the affected populations in the States targeted was held on 5 April 2013, in Geneva.
1- عُقدت في 5 نيسان/أبريل 2013 بجنيف حلقة عمل بشأن تأثير تطبيق التدابير القسرية الانفرادية على تمتع السكان المتضررين في الدول المستهدفة بحقوق الإنسان.

Delegations stated that the recommendations and proposals contained therein constituted a useful basis for the consideration of measures aimed at minimizing the negative impact of sanctions upon third States as well as upon vulnerable groups, in the target States.
وذكرت وفود أن التوصيات والمقترحات الواردة في ذلك التقرير تشكل أساسا مفيدا لوضع تدابير من أجل تقليل الأثر السلبي للجزاءات إلى الحد الأدنى على الدول الثالثة وكذلك على الفئات الضعيفة في الدول المستهدفة.

It was clear that sanctions often had an adverse impact on the most vulnerable groups in target States and that such sanctions did not necessarily result in any change in the policies of those States.
ومن الواضح أن الجزاءات كثيراً ما تؤدي إلى أثر سلبي على معظم الفئات المستضعفة في الدول المستهدفة في حين أن هذه الجزاءات لا ينجم عنها بالضرورة أي تغيير في سياسات تلك الدول.

Exclusion of international humanitarian organizations from the effect of sanctions limitations with a view to facilitating their work in countries which are the object of sanctions.
كما ينبغي استبعاد المنظمات الإنسانية الدولية من نطاق الجزاءات تسهيلا لعملها في الدول المستهدفة بالجزاءات؛

Experience has shown that sanctions have often had negative effects on the civilian population and caused huge material and economic losses in the targeted States.
وقد أثبتت التجربة أن أنظمة الجزاءات غالباً ما تنتج عنها أضرار مادية هائلة، وتلحق خسائر اقتصادية كبيرة بالسكان المدنيين في الدول المستهدفة.

25. In its resolution 19/32, the Human Rights Council requested the High Commissioner to organize a workshop on the various aspects relating to the impact of the application of unilateral coercive measures on the enjoyment of human rights by the affected populations in the States targeted, with the participation of States, academic experts and civil society representatives, and to prepare a report on the proceedings of the workshop.
25- طلب المجلس، في قراره 19/32، إلى المفوضة السامية أن تنظم حلقة عمل بشأن مختلف الجوانب المتصلة بتأثير تطبيق التدابير القسرية الانفرادية على تمتع السكان المتضررين في الدول المستهدفة بحقوق الإنسان، وذلك بمشاركة الدول والخبراء الأكاديميين وممثلي المجتمع المدني، وأن تُعدّ تقريراً عن وقائع حلقة العمل.

19. Notes with appreciation the holding of the workshop on the impact of the application of unilateral coercive measures on the enjoyment of human rights by the affected populations in the States targeted organized by the Office of the High Commissioner, on 5 April 2013, in Geneva;
19- يحيط علماً مع التقدير بعقد حلقة العمل بشأن تأثير تطبيق التدابير القسرية الانفرادية على تمتع السكان المتضررين في الدول المستهدفة بحقوق الإنسان، التي نظمتها المفوضية السامية في 5 نيسان/أبريل 2013 في جنيف؛

38. In its resolution 24/14, the Human Rights Council requested OHCHR to organize a workshop on the impact of the application of unilateral coercive measures on the enjoyment of human rights by the affected populations, in particular their socioeconomic impact on women and children in the States targeted.
38- طلب مجلس حقوق الإنسان، في قراره 24/14، إلى المفوضية أن تنظم حلقة عمل بشأن أثر تطبيق التدابير القسرية الانفرادية على تمتع السكان المتضررين بحقوق الإنسان، ولا سيما أثرها الاجتماعي - الاقتصادي على المرأة والطفل، في الدول المستهدفة.

83. Reference is made to the report of OHCHR on proceedings of the workshop on the impact of the application of unilateral coercive measures on the enjoyment of human rights by the affected populations, in particular their socioeconomic impact on women and children in the States targeted (A/HRC/27/32) (see para. 38 above).
83- يمكن الرجوع إلى تقرير المفوضية عن وقائع حلقة العمل بشأن أثر تطبيق التدابير القسرية الانفرادية على تمتع السكان المتضررين بحقوق الإنسان، ولا سيما أثرها الاجتماعي - الاقتصادي على المرأة والطفل، في الدول المستهدفة (A/HRC/27/32) (انظر الفقرة 38 أعلاه).

40. In April 2013, OHCHR, pursuant to Human Rights Council resolution 19/32, organized a workshop on the impact of the application of unilateral coercive measures on the enjoyment of human rights by the affected populations in the States targeted (see A/HRC/24/20).
40 - في نيسان/أبريل 2013، نظّمت مفوضية الأمم المتحدة لحقوق الإنسان، عملاً بقرار مجلس حقوق الإنسان 19/32، حلقة عمل عن تأثير تطبيق التدابير القسرية الانفرادية على تمتع السكان المتضررين في الدول المستهدفة بحقوق الإنسان (انظر A/HRC/24/20).

18. Also takes note of the report of the Office of the High Commissioner on the proceedings of the workshop on the various aspects relating to the impact of the application of unilateral coercive measures on the enjoyment of human rights by the affected populations in the States targeted, and takes positive note of the report of the Secretary-General to the General Assembly on human rights and unilateral coercive measures;
18- يحيط علماً أيضاً بتقرير المفوضية السامية عن وقائع حلقة العمل بشأن مختلف الجوانب المتصلة بتأثير تطبيق التدابير القسرية الانفرادية على تمتع السكان المتضررين في الدول المستهدفة بحقوق الإنسان()، وينوه بتقرير الأمين العام المقدم إلى الجمعية العامة بشأن حقوق الإنسان والتدابير القسرية الانفرادية()؛

(a) To organize, prior to the twenty-third session of the Human Rights Council, a workshop on the various aspects relating to the impact of the application of unilateral coercive measures on the enjoyment of human rights by the affected populations in the States targeted, with the participation of States, academic experts and civil society representatives;

53. Reference is made to the report of OHCHR on proceedings of the workshop on the various aspects relating to the impact of the application of unilateral coercive measures on the enjoyment of human rights by the affected populations in the States targeted (A/HRC/24/20) (see paragraph 25 above).
53- يمكن الرجوع إلى تقرير المفوضية عن وقائع حلقة العمل بشأن مختلف الجوانب المتصلة بتأثير تطبيق التدابير القسرية الانفرادية على تمتع السكان المتضررين في الدول المستهدفة بحقوق الإنسان (A/HRC/24/20) (انظر الفقرة 25 أعلاه).

They can cause enormous collateral negative effects to innocent and blameless civilians, including women, children, the aged and the infirm, in the target States as well as others before they achieve their objectives.
وهي يمكن أن تسبب آثارا جانبية سلبية هائلة تصيب المدنيين اﻷبرياء بلا جريرة ومنهم النساء واﻷطفال والمسنون والعجزة، في الدول المستهدفة وفي غيرها، قبل أن تحقق أهدافها.

Another consideration is the effect of coercive economic measures on vulnerable groups in target States and whether there are options for specifically targeting coercive economic measures on the policy makers in target States.
وثمة اعتبار آخر، هو تأثير التدابير الاقتصادية القسرية على الفئات المستضعفة في الدول المستهدفة وعلى الخيارات المتعلقة بأن تستهدف التدابير الاقتصادية القسرية صانعي السياسة على وجه التحديد في الدول المستهدفة.

Exclusion of international humanitarian organizations from the effect of sanctions limitations with a view to facilitating their work in countries which are the object of sanctions.
كما ينبغي استبعاد المنظمات الإنسانية الدولية من نطاق الجزاءات تسهيلا لعملها في الدول المستهدفة بالجزاءات.

26. Sanction regimes should be reviewed periodically, and adequate and prompt assistance should be provided on the basis of an assessment of humanitarian conditions in the targeted States and affected third States.
26 - ومضى قائلاً إنه ينبغي إعادة النظر في نُظم الجزاءات من فترة لأخرى، وينبغي تقديم المساعدة الوافية والعاجلة على أساس تقييم الظروف الإنسانية في الدول المستهدفة والدول الثالثة المتضررة.

Such measures may impede political, social and cultural progress in targeted States.
فمن شأن هذه التدابير عرقلة التقدم السياسي والاجتماعي والثقافي في الدول المستهدفة.

Although, in principle, sanctions aimed to change the behaviour of recalcitrant States, in practice they also affected the civil population and caused economic destabilization either in the targeted State, or in third States.
ويتعين تحديد مدتها وشروط رفعها أو تعليقها، مسبقاً، ويجب تقييم فعاليتها بشكل دوري، وعلى الرغم من أن العقوبات من حيث المبدأ تستهدف تغيير سلوك الدول المنتهكة إلا أنها عند تطبيقها تؤثر أيضاً في السكان المدنيين، وتتسبب في عدم استقرار اقتصادي سواءً في الدول المستهدفة أو في الدول النامية.
