وإذا اتخذت أي تدابير تراجعية عمداً، يقع على كاهل الدولة الطرف عبء إثبات أن هذه التدابير استحدثت بعد النظر بعناية قصوى في جميع البدائل، وأن هناك ما يبررها حقاً بالرجوع إلى جميع الحقوق المنصوص عليها في العهد في سياق الاستخدام الكامل لأقصى الموارد المتاحة للدولة الطرف.

If States do take deliberately retrogressive measures, then they have the burden of proving that they first carefully considered all alternatives, and that the measures " are duly justified by reference to the totality of the rights provided for in the Covenant in the context of the full use of the State party's maximum available resources " (para. 32).
وإذا اتخذت الدول عمداً أي تدابير تراجعية، فإنها تتحمّل عبء إثبات أن هذه التدابير اتُخذت بعد النظر بعناية قصوى في جميع التدابير البديلة، وأن " هناك ما يُبررها عن وجه حق بالرجوع إلى جميع الحقوق المنصوص عليها في العهد في سياق الاستخدام الكامل لأقصى الموارد المتاحة للدولة الطرف " (الفقرة 32)().
