She agreed with the representative of Jordan that there was no need for a reference to “grounds” in the chapeau.
٩٦١- وقالت انها تتفق مع ممثل اﻷردن على عدم الحاجة الى وضع اشارة الى " اﻷسباب " في الفاتحة .

The Working Group agreed to include the words " involving courts " after the word " cooperation " in the chapeau, in order to clarify its relationship with the following draft recommendations on cooperation between the courts.
22- اتفق الفريق العامل على إدراج عبارة " الذي يشمل المحاكم " بعد كلمة " التعاون " في الفاتحة لتوضيح علاقتها بمشاريع التوصيات التالية بشأن التعاون بين المحاكم.

A proposal to replace the words " should be implemented " in the chapeau with the words " may be implemented " was broadly supported.

General preference was expressed in favour of using the word " provided " in the chapeau to align the draft recommendation with the general usage in the Guide concerning post-commencement finance.
74- وأُبدي تفضيل عام لاستخدام كلمة " توفير " في الفاتحة لمواءمة مشروع التوصية مع الاستخدام العام في الدليل بشأن التمويل اللاحق لبدء الإجراءات.

It was said that the reference to the application of the rules on transparency pursuant " to an agreement by the parties to [the] treaty " in the chapeau was redundant and should be deleted.
76- وقيل إنَّ الإشارة إلى تطبيق قواعد الشفافية بموجب " اتفاق بين الأطراف في المعاهدة " الواردة في الفاتحة زائدة وينبغي حذفها.

However, if there was a large majority in favour of specifically enumerating prohibited weapons, it could accept option 1 provided the whole of option 3, and in particular the words “inherently indiscriminate”, were included in the chapeau.
وفي حالة وجود أغلبية كبيرة تفضل ذكر اﻷسلحة المحظورة ، فان وفده سيقبل الخيار ١ بشرط ادراج الخيار ٣ بأكمله ، وخاصة عبارة " عشوائية بطبيعتها " في الفاتحة .

٨٧ - وأضاف ان وفده يدعم التأييد الذي أبدي من أجل النص الخاص بالجرائم المرتكبة ضد الانسانية ، ولا سيما عبارة " واسع النطاق أو منهجي " الواردة في الفاتحة .

The insertion in the chapeau of a reference to weapons inherently indiscriminate in violation of international humanitarian law was very helpful, and subparagraph (vi) offered a potentially promising solution to the problem of weapons not included in the list.
وقال ان ادراج اشارة في الفاتحة الى اﻷسلحة التي تعتبر عشوائية بطبيعتها انتهاكا للقانون الانساني الدولي يعتبر شيئا مفيدا ، وان الفقرة الفرعية `٦` تتيح حلا قد يكون مفيدا بالنسبة لمشكلة اﻷسلحة غير المدرجة في القائمة .

Her delegation would like to see the word “or” rather than “and” used in the chapeau, as otherwise the threshold would be too high for prosecution to be possible.
٣٩ - وأضافت قائلة ان وفدها يؤيد وجود كلمة " أو " وليس " و " مستخدمة في الفاتحة ، ﻷن بدون ذلك ، سيكون المبتدى حدود الاختصاص أعلى من اللازم ، الى درجة قد لا تسمح باقامة الدعوى .

He therefore favoured option 1 of the chapeau.
ولذلك فانه يحبذ الخيار ١ في الفاتحة .

On war crimes (article 5 quater), she still preferred option 2 of the chapeau.
وبشأن جرائم الحرب )المادة ٥ رابعا( ، قالت انها لا تزال تفضل الخيار ٢ في الفاتحة .
