23- واستناداً إلى مجمل الأدلة المقدمة من صاحبي المطالبتين، وفي غياب أي رد من صاحب المطالبة الكويتي، يرى الفريق أن صاحب المطالبة الباكستاني أثبت ملكيته لنسبة 49 في المائة من المشروع في تاريخ غزو العراق واحتلالـه للكويت.

41- وفي حالة شركة الجيل الجديد للألبان والمواد الغذائية (Al Jil Al Jadid Dairy and Foodstuff Co.)، كان على الفريق أن ينظر في ما إذا كان يوجد اتفاق شراكة بين الشركة وفردين في تاريخ غزو العراق واحتلاله للكويت، في ضوء مطالبة بالتعويض عن حصة من هذه الشراكة قدمها أحد الفردين.

The claimant also stated that, as at the date of Iraq's invasion and occupation of Kuwait, the consigned stock was located in the storerooms of Kuwait Oil Co. The consigned stock appeared as a separate entry in the claimant's pre-invasion accounts and the claimant provided a schedule of stock stored at Kuwait Oil Co. together with supporting invoices and delivery notes.
