" Taking note of the Judgment of the International Court of Justice of 31 March 2004 in the case concerning Avena and Other Mexican Nationals, and recalling the obligations of States reaffirmed therein and subsequent rulings of the International Court of Justice following that Judgment,

In that respect, concern was expressed that the word " expertise " had broader meaning than what might be intended to be captured in that provision.

86. Addressing paragraph 2 of draft article 3, the Coordinator had recalled that the terms in that provision were terms employed in international humanitarian law and had taken on a very specific meaning over the years in the development of that law.

101. With respect to subparagraph (a), it was pointed out that the additional language contained in that provision was included so as to align the provision with the discussion in chapter III, paragraph 89 (a), of the Legislative Guide.
