وقيل إن الخيار الوارد في هذه القواعد بشأن رئيس الهيئة لم يمارَس إلا نادرا، إن مورس على الإطلاق.

Notwithstanding any provision in these Rules, where there is a conflict between the Rules on Transparency and the treaty, the provisions of the treaty shall prevail.
وفي حال وجود تنازع بين قواعد الشفافية وأحكام المعاهدة تكون الغلبة لأحكام المعاهدة، بصرف النظر عن أيِّ حكم في هذه القواعد.

Further, they shall periodically report on and take other measures fully to implement the Norms and to provide at least for the prompt implementation of the protections set forth in the Norms.

The Constitutional Court, in its decision, determined that some of the provisions contained in these Norms contravened the Political Constitution of Peru in the following main areas:
واعتبرت المحكمة الدستورية، في قرارها، أن بعض الأحكام الواردة في هذه القواعد تخالف الدستور السياسي لبيرو في المجالات الرئيسية التالية:

Paragraph 3 refers to hearings for the presentation of evidence or for oral hearing, which are dealt with later on in the rules.
وتشير الفقرة 3 إلى جلسات الاستماع من أجل عرض شهادات الشهود أو لتقديم مرافعات شفوية، وهو ما يأتي تناوله لاحقا في هذه القواعد.

For the purpose of these Rules:
في هذه القواعد:

" These Rules may be derogated from or their effect may be varied by agreement, unless that agreement would not be valid or effective under the law of the enacting State [or unless otherwise provided for in these Rules]. "

It was pointed out that the phrase “device or electronic agent” was a new concept in these Rules and might need to be defined.
٤٠١ - أشير الى أن عبارة " جهازا أو أداة الكترونية " مفهوم جديد في هذه القواعد وقد تكون ثمة حاجة الى تحديدها .

It is suggested that it could be spelt out more effectively thus: " There is no express power in these Rules given to the arbitral tribunal to grant a preliminary order pertinent to any interim measure without notice to the other party. "
ويُرى أن بالإمكان صوغ ذلك بمزيد من الفعّالية كما يلي: " ليس في هذه القواعد سلطة صريحة ممنوحة لهيئة التحكيم بإصدار أمر أولي متعلق بأي تدبير مؤقت دون إشعار الطرف الآخر. "

5. Nothing in these Rules requires a respondent State to make available to the public information the disclosure of which it considers to be contrary to its essential security interests.
5- ليس في هذه القواعد ما يقتضي من الدولة المدَّعى عليها أن تتيح لعامة الناس معلومات ترى أنَّ كشفها مناف لمصالحها الأمنية الأساسية.

" (3) Nothing in these Rules requires a respondent to make available to the public information the disclosure of which it considers to be contrary to its essential security interests.
" (3) ليس في هذه القواعد ما يقتضي من المدَّعى عليه أن يتيح لعامة الناس معلومات يرى أنَّ الكشف عنها يتعارض مع مصالحه الأمنية الأساسية.

" (5) Nothing in these Rules requires a respondent State to make available to the public or to non-disputing Parties to the treaty information the disclosure of which it considers to be contrary to its essential security interests.
" (5) ليس في هذه القواعد ما يقتضي من الدولة المدعى عليها أن تضع في متناول الجمهور أو الأطراف في المعاهدة غير المتنازِعة معلومات ترى أن إفشاءها مناف لمصالحها الأمنية الأساسية.

" There is ... a need to treat in these Rules those cases where a shared aquifer is an independent water resource body, not contributing water to a'common terminus' via a river system, or receiving significant amounts of water from any extant surface water body.

(a) This savings clause is intended to ensure that transnational corporations and other business enterprises will pursue the course of conduct that is the most protective of human rights - whether found in these Norms or in other relevant sources.
(أ) يهدف هذا الشرط الوقائي إلى ضمان انتهاج الشركات عبر الوطنية وغيرها من مؤسسات الأعمال نهج السلوك الأكثر حماية لحقوق الإنسان - سواء وجد في هذه القواعد أو في غيرها من المصادر ذات الصلة.

10.5 Substantial purchases of equipment, supplies and other requirements as specified in the rules shall be by tender. Such tenders shall be invited by advertisement, except where the Registrar, with the approval of the President, deems that, in the interests of the Tribunal, a departure from the rule is desirable.
١٠-٥ تطرح العطاءات للمشتريات الكبيرة من المعدات واللوازم والاحتياجات اﻷخرى المنصوص عليها في هذه القواعد عن طريق العطاءات، ويجري طرح العطاءات عن طريق اﻹعلان إلا إذا رأى المسجل، بموافقة الرئيس أن الخروج على هذه القاعدة أمر مستصوب لمصلحة المحكمة.

Unless provided otherwise in the present rules, the functions of the Court under Part 10 of the Statute shall be exercised by the Presidency.
