وفيما يتعلق بالمادة ٦٠١ ، قال ان وفده يرى أن جدول اﻷنصبة المقررة ينبغي أن يكون هو نفس جدول اﻷمم المتحدة .

With regard to article 105, his delegation considered that voluntary contributions would in no way affect the Court’s impartiality.
وفيما يتعلق بالمادة ٥٠١ ، قال ان وفده يرى أن تكون التبرعات بطريقة لا تؤثر على نزاهة المحكمة .

On article 112, his delegation considered that the Statute should be opened for signature following the successful conclusion of the Conference, and favoured inclusion of article 113 for the reasons advanced by the Norwegian delegation.
وبخصوص المادة ٢١١ ، قال ان وفده يرى أن النظام اﻷساسي ينبغي أن يفتح باب التوقيع عليه عقب انتهاء المؤتمر بنجاح ، وهو يحبذ ادراج المادة ٣١١ لﻷسباب التي قدمها وفد النرويج .

Concerning the balance to be struck between the independence of the Court and the powers of the Council in matters being dealt with by the Council, his delegation believed that option 2 for article 10, the proposal by Singapore and Canada, in conjunction with article 10, paragraph 2, of the further option, represented the best approach for finding an acceptable solution.
وبخصوص التوازن الذي يجب أن يكون بين استقلال المحكمة وسلطات المجلس في المسائل التي يتناولها المجلس ، قال ان وفده يرى أن الخيار ٢ فيما يتعلق بالمادة ٠١ ، وهو الاقتراح المقدم من سنغافورة وكندا ، بالاقتران مع فقرة ٢ من المادة ٠١ في خيار آخر ، انما تمثل أفضل نهج لايجاد حل مقبول .

On article 7, his delegation considered that the Court should have automatic jurisdiction over all the core crimes.
٠٦ - وبشأن المادة ٧ ، قال ان وفده يرى أن يكون للمحكمة اختصاص تلقائي على جميع الجرائم اﻷساسية .

With regard to the preconditions for the exercise of jurisdiction, his delegation considered that the core crimes would warrant universal jurisdiction.
٧٨ - وفيما يتعلق بالشروط المسبقة لممارسة الاختصاص ، قال ان وفده يرى أن الجرائم اﻷساسية تبرر الاختصاص العالمي .

With regard to article 7 on acceptance of jurisdiction, his delegation considered that option 1 was acceptable.
٠٥١- وفيما يتعلق بالمادة ٧ بشأن قبول الاختصاص ، قال ان وفده يرى أن الخيار ١ يعتبر مقبولا .

Mr. SALINAS (Chile) said that his delegation considered that article 14 was unnecessary and should be deleted.
٩٢ - السيد ساليناس )شيلي( : قال ان وفده يرى أن المادة ٤١ غير ضرورية وينبغي حذفها .

With regard to article 105, his delegation considered that very strict criteria governing voluntary contributions would have to be drawn up to avoid their affecting the Court’s impartiality.
٤٦ - وفيما يتعلق بالمادة ٥٠١ ، قال ان وفده يرى أنه يتعين وضع معايير صارمة جدا تنظم التبرعات وذلك لتجنب تأثيرها على نزاهة المحكمة .

With respect to article 10 (1), his delegation considered that option 1 was essential.
٦٤ - وفيما يتعلق بالمادة ٠١ )١( قال ان وفده يرى أن الخيار ١ أساسي جدا .

On the question of complementarity, his delegation considered that article 15 should be retained in its current form, since it represented a carefully crafted compromise.
٥٨ - وبشأن مسألة التكامل ، قال ان وفده يرى أن المادة ٥١ ينبغي الابقاء عليها بصيغتها الحالية حيث انها تمثل حلا توفيقيا جرت صياغته بدقة .

As to what States had to be parties to the Statute or to have accepted the Court’s jurisdiction before the Court could act, his delegation considered that there had to be preliminary agreement by the State on whose territory the crime was committed and by the custodial State.
٣١١- وبالنسبة للدول التي يتعين أن تكون أطرافا في النظام اﻷساسي أو أن تقبل اختصاص المحكمة قبل أن تتصرف المحكمة ، قال ان وفده يرى أنه لا بد من وجود اتفاق أولي من الدولة التي وقعت على أرضها الجريمة ومن الدولة المتحفظة .

With regard to the role of the Prosecutor, his delegation considered that option 1 for article 12 was preferable, since it made provision for all necessary safeguards.
٢٥١- وفيما يتعلق بدور المدعي العام ، قال ان وفده يرى أن الخيار ١ فيما يتعلق بالمادة ٢١ هو موضع التفضيل حيث انه يقدم أحكاما تتعلق بجميع الضمانات الضرورية .

In connection with referral by the Security Council, his delegation considered that the obligations imposed on States parties to supply relevant information needed to be revised.
٧٦١- وفيما يتعلق بالتأجيل بأمر من مجلس اﻷمن ، قال ان وفده يرى أن الالتزامات المفروضة على الدول اﻷطراف بتقديم معلومات ذات صلة تحتاج الى اعادة نظر .

As far as crimes against humanity were concerned, his delegation considered that the wording in paragraph 1 should be “widespread or systematic commission of such acts”.
٦٣ - وفيما يتعلق بالجرائم المرتكبة ضد الانسانية ، قال ان وفده يرى أن صياغة الفقرة ١ يجب أن تكون في " اطار عملية ارتكاب واسعة النطاق أو منهجية لمثل هذه اﻷفعال " .

Mr. YAÑEZ-BARNUEVO (Spain) said that his delegation considered that the Statute should make provision for the Security Council to be able to refer situations to the Court whenever crimes specified in the Statute appeared to have been committed.
٧ - السيد يانييز - بارنويفو )اسبانيا( : قال ان وفده يرى أن يتضمن النظام اﻷساسي أحكاما تنص على أن يكون مجلس اﻷمن قادرا على احالة حالات الى المحكمة كلما ظهر أن جرائم محددة في النظام اﻷساسي قد ارتكبت .

With regard to paragraph 2 (f), his delegation considered that the Assembly of States Parties should be the sole body to consider non-cooperation by States parties or States not parties.
٤٢ - وفيما يتعلق بالفقرة ٢ )و( ، قال ان وفده يرى أن تكون جمعية الدول اﻷطراف هي الهيئة الوحيدة للنظر في عدم تعاون الدول اﻷطراف أو الدول غير اﻷطراف .

With respect to automatic jurisdiction, his delegation believed that any State party to the Statute should, by virtue of its ratification of the treaty, accept the Court’s jurisdiction over genocide.
٣٤ - وفيما يتعلق بالاختصاص التلقائي ، قال ان وفده يرى أن أي دولة طرف في النظام اﻷساسي ينبغي ، بفعل تصديقها على المعاهدة ، أن تقبل اختصاص المحكمة على الابادة الجماعية .

With respect to article 11, his delegation believed that option 1 for paragraph 3 was a necessary provision for coordination between the Court and the Security Council.
٩٤ - وفيما يتعلق بالمادة ١١ ، قال ان وفده يرى أن الخيار ١ فيما يتعلق بالفقرة ٣ يعتبر حكما ضروريا من أجل التنسيق بين المحكمة ومجلس اﻷمن .

As far as crimes against humanity were concerned, his delegation believed that the definition in the Statute should cover acts committed as part of a widespread or systematic commission of such acts against any population, whether committed in peacetime or in international or internal armed conflict.
٥٥ - وفيما يتعلق بالجرائم المرتكبة ضد الانسانية ، قال ان وفده يرى أن التعريف الوارد في النظام اﻷساسي يجب أن يشمل اﻷفعال المرتكبة في اطار عملية ارتكاب واسعة النطاق أو منهجية لمثل هذه اﻷفعال ضد أي مجموعة من السكان سواء كانت مرتكبة في وقت السلم أو خلال النزاع المسلح الدولي أو الداخلي .

Mr. DOUDECH (Tunisia) said his delegation felt that option 2 on exercise of jurisdiction was the one most likely to ensure the effectiveness of the Court.
٦ - السيد دودتيش )تونس( : قال ان وفده يرى أن الخيار ٢ بشأن ممارسة الاختصاص هو اﻷرجح في أن يكفل فعالية المحكمة .
