وبعبارة أخرى، فما لم توافق الولايات المتحدة بصفة محددة على أن تجعل أحكام معاهدة معينة جزءاً من مجوعة قوانينها المحلية النافذة قضائيا، فقد تتبع البدائل المتاحة لها بموجب قانونها الخاص لتنفيذ الالتزامات التعاهدية في القانون المحلي.

25- وأما فيما يتعلق بنطاق تطبيق برنامج العدالة التصالحية، قالت الكويت ان قانونها الخاص بالمصالحة وضع قيودا على التطبيق، قُصد بها منع المصالحة من أن تُستغل كذريعة لإفلات الجناة من العقاب، وأن تحافظ على حقوق الضحية والمجتمع، وأن تكفل الردع الملائم.

90 - وعلى المستوى الوطني، أشارت فنزويلا إلى قانونها الخاص بمكافحة الجريمة الحاسوبية وإلى القانون العام المعني بالمصارف والمؤسسات المالية الأخرى، وقد سُن القانونان كلاهما في عام 2001.

The Netherlands Antilles is considering a similar act on equality of treatment.

III. With respect to article 13 of the International Covenant on Civil and Political Rights, the Government of the Republic of India reserves its right to apply its law relating to foreigners.

ولعل الدول التي تشترع توصيات الدليل تود النظر في قانونها الخاص بالملكية الفكرية لكي تقرر ما إذا كان ينبغي السماح بتلك الاتفاقات، لأن ذلك يمكن أن ييسِّر استخدام الممتلكات الفكرية كضمانة للائتمان.
