The Committee notes in this respect the State party's arguments that the author was informed about the possibility to have the assistance of a lawyer but chose not to exercise this right and that the criminal procedure law in force at the material time did not provide for the mandatory participation of a lawyer in cassation proceedings.
وتُشير اللجنة في هذا الصدد إلى أن الدولة الطرف تحاجج بالقول إن صاحب البلاغ أُخبر بإمكانية الحصول على مساعدة محام بيد أنه اختار عدم ممارسة هذا الحق وأن قانون الإجراءات الجنائية المعمول به آنذاك لم يكن ينص على المشاركة الإلزامية لمحام أثناء إجراءات الطعن بالنقض.

The provision providing for extension of police custody to ten or even fifteen days was obsolete -- a relic of the Code of Criminal Procedure in force in the Soviet era.
