But, whether a State is acting legally or illegally under the ius ad bellum, if it is in fact using force it must always do so in the manner prescribed by the ius in bello.

The essential point is that some violations such as aggression and genocide are such an affront to the international community as a whole that they need to be distinguished from other violations, in the same way we know them from the laws of war, with the distinction drawn between " breaches " and " grave breaches " of those rules.
