30. Article 1 of the Juvenile Delinquents Act No. 18 of 30 March 1974, as amended, stipulates as follows:
٠٣- أما قانون اﻷحداث الجانحين رقم ٨١ تاريخ ٠٣-٣-٤٧٩١ وتعديلاته فقد نص في المادة ١ منه على أنه " .

115. Article 7 of the Juvenile Delinquents Act No. 18 of 1974 stipulates that, if the parents or legal guardian of the juvenile do not meet the moral requirements or are incapable of undertaking his upbringing, he must be placed in the custody of a member of his family.
٥١١- فقد نصت المادة ٧ من قانون اﻷحداث الجانحين رقم ٨١ لعام ٤٧٩١ على أنه إذا لم تتوفر في أبوي الحدث أو في وليه الشرعي الضمانات الاخلاقية أو لم يكن باستطاعتهم القيام بتربيته، سلم إلى أحد أفراد أسرته.

This measure can be taken during the hearing of the case and before judgement is passed (art. 47 of the Juvenile Delinquents Act).
ويمكن اتخاذ هذا التدبير أثناء رؤية الدعوى وقبل إصدار الحكم )المادة ٧٤ من قانون اﻷحداث الجانحين(.

243. Under the terms of the Juvenile Delinquents Act, young offenders at this stage of childhood are liable to reduced penalties (art. 3, para. (b), of the Act).
٣٤٢- واستثنى قانون اﻷحداث الجانحين في هذه المرحلة اﻷطفال الذين يرتكبون جنايات فقرر لهم عقوبات مخففة )م٣/ب منه(.

3. the Juvenile Delinquents Act No. 18 of 1974 classifies this category of persons and specifies the procedures for their trial, reform and care in the following articles.
٣- صنف قانون اﻷحداث الجانحين رقم ٨١ لعام ٤٧٩١ هذه الفئة من اﻷشخاص، وحدد إجراءات محاكمتهم وإصلاحهم ورعايتهم في المادتين التاليتين:

35. Article 2 of the Juvenile Delinquents Act further stipulates: " No juvenile shall be liable to criminal prosecution for an offence that he committed when he was under seven years of age " .
٥٣- كما نصت المادة الثانية من قانون اﻷحداث الجانحين على أنه " لا يلاحق جزائياً الحدث الذي لم يتم السابعة من عمره حين ارتكاب الفعل " .

The Committee notes with concern the inadequacy of the review procedure established under the Juvenile Offenders Act and of access to the complaint mechanisms for children whose rights have been violated.
وتلاحظ اللجنة بقلق قصور إجراء الاستعراض الذي ينص عليه قانون الأحداث الجانحين وعدم الوصول إلى آليات التظلم بالنسبة للأطفال الذين انتُهِكت حقوقهم.

Moreover, the Committee is concerned that the Anti-Gang Laws undermine the Juvenile Offenders Act by introducing a dual system of juvenile justice.
كما تشعر اللجنة بالقلق لأن قوانين مكافحة العصابات تقوّض قانون الأحداث الجانحين لأنها تنشئ نظاماًً ثنائياً لقضاء الأحداث.

4. the Juvenile Offenders Law (cap. 157) deals with child offenders (under 14 and not over 16 years).
٤- يتناول قانون اﻷحداث الجانحين )الفصل ٧٥١(، اﻷطفال الجانحين )الذين يقل عمرهم عن ٤١ عاماً ولا يتجاوز ٦١ عاماً(.

A " juvenile " is defined under the Juvenile Delinquents and Vagrants Act as a person who, at the time of commission of the act, was less than 18 years of age.
ويُعرَّف " الحَدَث " ، بموجب قانون الأحداث الجانحين والمشردين، بأنه الشخص الذي كان عمره وقت ارتكاب الفعل أقل من 18 سنة.
