1. The ICTY and ICTR shall have competence to conduct, and complete, all review proceedings for which the application for review of the judgment is filed prior to the commencement date of the respective branch of the Mechanism.
1 - يكون لمحكمة يوغوسلافيا ومحكمة رواندا، اختصاص إجراء وإنهاء جميع إجراءات إعادة النظر التي يودع من أجلها طلب إعادة النظر في الحكم قبل تاريخ بدء عمل فرعي الآلية.

1. The ICTY and ICTR shall have competence to conduct, and complete, all proceedings for contempt of court and false testimony for which the indictment is confirmed prior to the commencement date of the respective branch of the Mechanism.
1 - يكون لمحكمة يوغوسلافيا ومحكمة رواندا، اختصاص إجراء وإنهاء جميع الإجراءات المتعلقة بانتهاك حرمة المحكمة وشهادة الزور التي يثبتها قرار الاتهام قبل تاريخ بدء عمل فرعي الآلية.

Also recommends that, subject to any provision in the relevant investment treaties that may require a higher degree of transparency, the Rules on Transparency be applied through appropriate mechanisms to investor-State arbitration initiated pursuant to investment treaties concluded before the date of coming into effect of the Rules on Transparency, to the extent such application is consistent with those investment treaties.
" توصي أيضا، رهناً بأيِّ حكم في معاهدات الاستثمار المعنية قد يقتضي درجة أعلى من الشفافية، بأن تُطبّق قواعد الشفافية من خلال آليات مناسبة على التحكيم بين المستثمرين والدول، الذي يُستهلّ عملاً بمعاهدة استثمار أبرمت قبل تاريخ بدء نفاذ قواعد الشفافية، طالما كان ذلك التطبيق متسقاً مع معاهدة الاستثمار تلك " .

7. 7 - يطلب إلى جميع الدول التقيد بأحكام هذا القرار بغض النظر عن وجود أي حقوق أو التزامات ممنوحة أو مفروضة بموجب أي اتفاق دولي أو أي عقد تم إبرامه أو أي ترخيص أو إذن ممنوح قبل تاريخ بدء نفاذ التدابير المفروضة في الفقرة 4 أعلاه؛

Moreover, article 28 of the 1969 Vienna Convention on the Law of Treaties codifies international practice as follows: " Unless a different intention appears from the treaty or is otherwise established, its provisions do not bind a party in relation to any act or fact which took place or any situation which ceased to exist before the date of the entry into force of the treaty with respect to that party. "
ومن جهة أخرى، تقنِّن المادة 28 من اتفاقية فيينا لقانون المعاهدات لعام 1969 الممارسة الدولية في هذا الاتجاه: " لا تلزم أحكام المعاهدة أي طرف بشأن أي عمل حدث أو واقعة حدثت أو حالة توقفت عن الوجود قبل تاريخ بدء نفاذ المعاهدة على هذا الطرف، ما لم يتبين من المعاهدة أو يثبت بطريقة أخرى قصد مغاير لذلك " .
