Article 13 of the Statute prescribes that a situation can be referred to the Court by a State party, the Prosecutor or the Security Council in accordance with Chapter VII of the Charter of the United Nations.
فالمادة 13 من النظام الأساسي تنص على إمكانية إحالة حالة إلى المحكمة من قبل دولة طرف أو المدعي العام أو مجلس الأمن وفقا للفصل السابع من ميثاق الأمم المتحدة.

Article 5 stipulates, inter alia, that none of the provisions should preclude the recognition of fundamental human rights by a State party pursuant to law, conventions, regulation or custom on the basis that the Covenant does not recognize such rights or that it recognizes them to a lesser extent.
وتنص المادة ٥، من جملة أمور، على أنه ليس في أحكام العهد ما يهدف الى اهدار حقوق الانسان السياسية المعترف بها من قبل دولة طرف تطبيقا لقوانين أو اتفاقيات أو أنظمة أو أعراف، على أساس أن العهد لا يعترف بهذه الحقوق أو أن اعترافه بها أضيق مدى.

The statute of limitation shall be interrupted, if an investigation or prosecution has been initiated during this period, either before the Court or by a State party with jurisdiction over the case pursuant to article 70, paragraph 4 (a).
تنقطع فترة التقادم إذا استهل خلال هذه الفترة أي تحقيق أو مقاضاة، إما أمام المحكمة أو من قبل دولة طرف لها ولاية قضائية على الدعوى عملا بالفقرة ٤ )أ( من المادة ٧٠.

On exercise of jurisdiction, situations should be referred to the Prosecutor only by a State party, and paragraphs (b) and (c) of article 6 should therefore be deleted.
وبشأن ممارسة الاختصاص ، ينبغي احالة حالات الى المدعي العام من قبل دولة طرف فقط وينبغي حذف الفقرتين )ب( و )ج( من المادة ٦ .

In accordance with article 8, paragraph 1, of the Optional Protocol, if the Committee receives reliable information indicating grave or systematic violations by a State party of rights set forth in the Convention, the Committee shall invite that State party to cooperate in the examination of the information and, to this end, to submit observations with regard to the information concerned.
35 - وفقا للفقرة 1 من المادة 8 من البروتوكول الاختياري، إذا حصلت اللجنة على معلومات يعتد بها تشير إلى وجود انتهاكات منتظمة خطيرة من قبل دولة طرف للحقوق الواردة في الاتفاقية، على اللجنة دعوة تلك الدولة الطرف إلى التعاون في دراسة المعلومات وإرسال ملاحظات عن المعلومات المعنية.

439. (ب) تقديم أدلة على حدوث انتهاكات جسيمة ومنهجية للحقوق المنصوص عليها في الاتفاقية من قبل دولة طرف في البروتوكول الاختياري؛

On the referral of a situation by a State party, the simple provisions contained in article 6 (a) in the “Further option for articles 6, 7 10 and 11” were, generally speaking, satisfactory.
وبشأن احالة حالة من قبل دولة طرف ، فان اﻷحكام البسيطة الواردة في المادة ٦ )أ( في " خيار آخر للمواد ٦ و ٧ و ٠١ و ١١ " تعتبر عموما مرضية .

Ms. KAMALUDIN (Brunei Darussalam) said that her delegation had no problem with the referral of a situation by a State party in accordance with article 6 (in the “Further option for articles 6, 7, 10 and 11”), and was giving careful consideration to the proposal of the Republic of Korea for article 8, in respect of the requirement of State consent.

On the question of referral of a matter or situation by a State party to the Prosecutor, he was now ready to support option 1 for paragraph 1 of article 11 (original version), allowing any State party to lodge a complaint with the Prosecutor.
وبشأن موضوع احالة مسألة أو حالة من قبل دولة طرف الى المدعي العام ، فانه مستعد اﻵن لتأييد الخيار ١ فيما يتعلق بالفقرة ١ من المادة ١١ )النص اﻷصلي( ، بما يسمح ﻷي دولة طرف بأن تودع شكوى لدى المدعي العام .

In weighing the effects of logging, or indeed any other measures taken by a State party that has an impact on a minority's culture, the Committee noted that the infringement of a minority's right to enjoy its own culture, as provided for in article 27, might result from the combined effects of a series of actions or measures taken by a State party over a period of time and in more than one area of the State occupied by that minority.
202- إن اللجنة، عند قياسها آثار قطع الأشجار، أو أي تدابير أخرى تتخذها دولة طرف وتخلف أثرا على ثقافة أقلية، تلاحظ أن انتهاك حق أقلية في التمتع بثقافتها، وفق ما تنص عليه المادة 27، قد ينجم عن الآثار المجتمعة لسلسلة من الإجراءات أو التدابير المتخذة من قبل دولة طرف طوال فترة من الزمن وفي أكثر من منطقة من مناطق الدولة التي تستوطنها تلك الأقلية.

2. Concerning draft guideline 2.6.5 ( " Author of an objection " ), his delegation understood the phrase " any State and any international organization that is entitled to become a party to the treaty " to mean signatory States and international organizations; a State or international organization that had no intention of becoming a party to a treaty should not have the right to object to a reservation made by a State party.
2 - وفيما يتعلق بمشروع المبدأ التوجيهي 2-6-5 ( " مصدر الاعتراض " )، قال إن وفده يفهم أن عبارة " أية دولة وأية منظمة دولية لها الحق في أن تصبح طرفا في المعاهدة " تعني الدول الموقعة والمنظمات الدولية. والدولة أو المنظمة الدولية التي لا تعتزم أن تصبح طرفا في معاهدة يجب ألا يكون لها الحق في الاعتراض على تحفظ من قبل دولة طرف.
