Following from the above, the State Party believes that there is no violation of any of the rights contained in articles 7, 17, 24, paragraph 1, read alone or in conjunction with article 2, paragraphs 1 and 3.

The facts are not contested by the State party but it considers that there has not been a violation of any of the rights protected in the Covenant, since the potential danger constituted by a motor vehicle requires that road traffic should be rigorously protected.

Firstly, counsel argues that the Preamble to the Optional Protocol as well as its articles 1 and 2 all state that the Protocol gives competence to the Committee to receive and consider communications from individuals subject to the jurisdiction of a State party who claim to be victims of a violation by the State party of any of the rights set forth in the Covenant.

Its object and purpose is to recognize the competence of the Committee to receive and consider communications from individuals who claim to be victims of a violation by a State party of any of the rights in the Covenant. States accept the substantive rights of individuals by reference to the Covenant, and not the first Optional Protocol.
وإن غاية البروتوكول وغرضه هما الاعتراف باختصاص اللجنة في أن تتلقى وتبحث البلاغات التي ترد من الأفراد الذين يزعمون أنهم ضحايا لانتهاك ارتكبته دولة من الدول الأطراف لأي حق من الحقوق المنصوص عليها في العهد والدول تقبل الحقوق الأساسية للأفراد على أساس العهد وليس على أساس البروتوكول الاختياري الأول.

(b) That the individual claims, in a manner sufficiently substantiated, to be a victim of a violation by that State party of any of the rights set forth in the Covenant.
(ب) أن الفرد يدعي، بطريقة مدعمة بحجج كافية، أنه ضحية انتهاك من جانب تلك الدولة الطرف لأي حق من الحقوق المبينة في العهد.

The Committee recalls that, under article 1 of the Optional Protocol, a State party recognizes the competence of the Committee to consider communications from individuals subject to its jurisdiction who claim to be victims of a violation by that State party of any of the rights set forth in the Covenant.

573. Under article 14 of the International Convention on the Elimination of All Forms of Racial Discrimination, individuals or groups of individuals who claim that any of their rights enumerated in the Convention have been violated by a State party and who have exhausted all available domestic remedies may submit written communications to the Committee on the Elimination of Racial Discrimination for consideration.

On 11 March 2003, ECHR found that neither complaint disclosed any violation of any rights under the Convention.
