As shown above, the articles adopted on first reading by the Third Committee of the Conference for the Codification of International Law at The Hague in 1930 provided that the claimant was excused from exhausting local remedies when he was " hindered by the judicial authorities in the exercise of his right to pursue judicial remedies " or had " encountered in the proceedings unjustifiable obstacles or delays implying a refusal to do justice " .
