In fact, if a State is assumed not to be ignorant of the prohibition resulting from a reservation clause, it should be equally aware that it cannot divest a treaty of its substance through a reservation that is incompatible with the treaty's object and purpose.
والحقيقة أنه إذا كانت الدولة لا يفترض فيها جهلها بالمنع الناجم عن بند تحفظ، فإنه يتعين عليها كذلك أن تدرك أنه لا يجوز لها أن تفرغ معاهدة من محتواها بتحفظ يتنافى مع موضوع المعاهدة والغرض منها.
