1. In order to determine the object and purpose of the treaty, the treaty as a whole must be interpreted in good faith in accordance with the ordinary meaning to be given to the terms of the treaty in their context.

(a) Ordinary meaning to be given to the terms of the treaty
(أ) المعنى العادي الذي يعطى لتعابير المعاهدة

It has therefore made its consent to be bound by the treaty dependent upon a particular " interpretation " which -- it is assumed -- does not fall within the ordinary meaning to be given to the terms of the treaty in their context and in the light of its object and purpose.
وقد اشترط إذن منح موافقته على أن يُلزم بالمعاهدة ب " تفسير " خاص لا يتوافق - من الناحية الفرضية - مع المعنى العادي الذي يُعطى لتعابير المعاهدة في السياق الذي ترد فيه وفي ضوء موضوعها وغرضها.

1 - لتحديد غرض المعاهدة ومقصدها، يجب تفسير المعاهدة بأكملها بحسن نية، وفقا للمعنى العادي الذي يعطى لتعابير المعاهدة في السياق الذي ترد فيه.

25. A treaty shall be interpreted in accordance with the ordinary meaning to be given to the " terms of the treaty in their context " (article 31 (1)).
25 - تفسر المعاهدة وفقاً للمعنى العادي الذي يعطى " لتعابير المعاهدة في السياق الذي ترد فيه " (المادة 31 (1)).

The context for the purpose of the interpretation of a treaty shall comprise, in addition to the text, including its preamble and annexes:
٤٥- ويسترشد الفريق لدى تفسيره لقرار مجلس اﻷمن ٧٨٦ )١٩٩١( باتفاقية فيينا لقانون المعاهدات ) " اتفاقية فيينا " ( التي تنص في الفرع ٣ على ما يلي " )أ( تفسر المعاهدات بنية حسنة وفقاً للمعاني العادية التي ينبغي إعطاؤها لتعابير المعاهدة حسب السياق الوارد فيه وفي ضوء موضوع المعاهدة وغرضها " )١١(.

9. Article 31.1 of the 1969 Vienna Convention on the Law of Treaties provides that a treaty'shall be interpreted in good faith, in accordance with the ordinary meaning to be given to the terms of the treaty in their context and in the light of its object and purpose'.
9- وتنص الفقرة 1 من المادة 31 من اتفاقية فيينا لقانون المعاهدات لعام 1969 على أن `تفسر المعاهدة بحسن نية وفقاً للمعنى العادي الذي يُعطى لتعابير المعاهدة في السياق الذي ترد فيه وفي ضوء موضوع المعاهدة وغرضها`.

فالإعلانات تعبير عن عنصر ذاتي في التفسير، هو نية إحدى الدول الأطراف، ولذلك من شأنها تأكيد " المعنى العادي الذي يعطَى لتعابير المعاهدة في السياق الذي ترد فيه وفي ضوء موضوع المعاهدة وغرضها " .
