5.3 The author points out that he was detained by the Moroccan police without being brought before a judge for the maximum period provided for in Moroccan law, in clear violation of his rights under the Covenant.

8.4 With regard to the State party's argument that the author is not a victim under article 1 of the Optional Protocol, the Committee notes that the claim was brought against Austria as State party to the Optional Protocol and refers to the State party's failure to ensure that the author does not suffer any consequential breaches of his rights under the Covenant following his extradition from Austria to the United States of America.
8-4 وفيما يتعلق بحجة الدولة الطرف القائلة إن صاحب البلاغ ليس ضحية بمقتضى المادة 1 من البروتوكول الاختياري، تلاحظ اللجنة أن الدعوى رفعت على النمسا بصفتها دولة طرفاً في البروتوكول الاختياري، وتشير إلى عدم حماية صاحب البلاغ من التعرض لأي انتهاكات لحقوقه بموجب العهد من جراء تسليمه إلى الولايات المتحدة.

The author claims that these proceedings do not relate to his communication before the Committee, with which the author seeks to establish a violation of his rights under the Covenant with regard to the 14 April 2004 change of property registration in the Land Registry initiated by the representative of the State party before the ECHR.

The main issue to be considered by the Committee was whether, by allowing the author to leave the premises of the Romanian Embassy in Baghdad, the State party exercised jurisdiction over him in a way that exposed him to a real risk of becoming a victim of violations of his rights under the Covenant and could reasonably have been anticipated.
204- وكانت المسألة الرئيسية التي يتعين على اللجنة أن تنظر فيها هي معرفة ما إذا كانت الدولة الطرف، بسماحها لصاحب البلاغ بمغادرة مرافق السفارة الرومانية في بغداد، قد مارست ولاية قضائية على صاحب البلاغ على نحو عرّضه لخطر حقيق جعله يقع ضحية انتهاكات لحقوقه بموجب العهد وهو ما كان من المعقول توقعه.

204. The main issue to be considered by the Committee was whether, by allowing the author to leave the premises of the Romanian Embassy in Baghdad, the State party exercised jurisdiction over him in a way that exposed him to a real risk of becoming a victim of violations of his rights under the Covenant and could reasonably have been anticipated.
204 - وكانت المسألة الرئيسية التي يتعين على اللجنة أن تنظر فيها هي معرفة ما إذا كانت الدولة الطرف، بسماحها لصاحب البلاغ بمغادرة مرافق السفارة الرومانية في بغداد، قد مارست ولاية قضائية على صاحب البلاغ على نحو عرّضه لخطر حقيق جعله يقع ضحية انتهاكات لحقوقه بموجب العهد وهو ما كان من المعقول توقعه.

14.1 Before addressing the merits of the communication, the Committee observes that what is at issue is not whether Mr. Ng's rights have been or are likely to be violated by the United States, which is not a State party to the Optional Protocol, but whether by extraditing Mr. Ng to the United States, Canada exposed him to a real risk of a violation of his rights under the Covenant.
٤١-١ وقبل بحث الجوانب الموضوعية للبلاغ، تشير اللجنة إلى أن نقطة الخلاف ليست ما إذا كانت الولايات المتحدة، وهي ليست طرفا في البروتوكول الاختياري، قد انتهكت أو لم تنتهك، أو يحتمل أو لا يحتمل أن تنتهك، حقوق السيد نغ، ولكن ما إذا كانت كندا، بتسليمها السيد نغ إلى الولايات المتحدة، قد عرضته أو لم تعرضه لخطر حقيقي يتمثل في حدوث انتهاك لحقوقه بموجب العهد.
