11. The Human Rights Committee, acting under article 5, paragraph 4, of the Optional Protocol to the International Covenant on Civil and Political Rights, is of the view that the facts before it disclose a violation of the author's rights under article 17, in conjunction with article 14, paragraph 1, of the Covenant.
11- واللجنة المعنية بحقوق الإنسان، إذ تتصرف بموجب أحكام الفقرة 4 من المادة 5 من البروتوكول الاختياري الملحق بالعهد الدولي الخاص بالحقوق المدنية والسياسية، ترى أن الوقائع المعروضة عليها تكشف عن حدوث انتهاك لحقوق صاحبة البلاغ بموجب المادة 17 مقترنة بالفقرة 1 من المادة 14 الفقرة من العهد.

3.9 The fact that the incomes of both partners were taken into consideration at the time that the contract was drawn up cannot, in my view, be interpreted as a violation of the author's rights under article 16, paragraph 1 (h), either.
3-9 وقرار الهيئة المعنية بأن تأخذ في الحسبان دخل كل من صاحبة البلاغ وعشيرها عند تحرير العقد لا يمكن، في رأيي الخاص، اعتباره انتهاكاً لحقوق صاحبة البلاغ بموجب الفقرة 1(ح) من المادة 16.

It appears to have been common knowledge that the two of them lived together, and the provision of such information would therefore not constitute a violation of the author's rights under article 16, paragraph 1 (h).
