In particular, the SPT noticed that the NPM did not pay adequate attention to the reasons for which persons were deprived of their liberty and to the issues of respecting legal safeguards, and that of non-refoulement in the context of deportations to the countries where there are substantial grounds for believing that a person would be at risk of torture or ill-treatment upon return.

The SPT also recommends to the NPM that it (i) evaluates the reasons why persons were deprived of their liberty, (ii) considers the extent to which legal safeguards are observed in practice, and (iii) considers the practice concerning the obligation of non-refoulement in the context of deportations to the countries where there are substantial grounds for believing that a person would be at risk of torture or ill-treatment upon return.
وتوصي اللجنة الفرعية الآلية الوقائية الوطنية أيضاً بما يلي: `1` أن تقيِّم أسباب حرمان الأشخاص من حرياتهم، `2` أن تنظر في مدى احترام الضمانات القانونية عملياً، `3` أن تنظر في الممارسة المتعلقة بالالتزام بعدم الإعادة القسرية في سياق عمليات الترحيل إلى بلدان تكون فيها أسباب حقيقية تدعو للاعتقاد بأن الشخص سيتعرض لخطر التعذيب أو سوء المعاملة عند عودته إلى البلد المعني.

The Committee recommends that the State party refrain from seeking and accepting diplomatic assurances, both in the context of extradition and deportation, from the State where there are substantial grounds for believing that a person would be at risk of torture or ill-treatment upon return to the State concerned, and desist from returning a person to the country of origin where there is a risk of torture or ill-treatment.
توصي اللجنة الدولة الطرف بأن تعدل عن التماس وقبول الضمانات الدبلوماسية وذلك في كل من سياق التسليم والترحيل، من دولة تكون فيها أسباب حقيقية تدعو للاعتقاد بأن الشخص سيتعرض لخطر التعذيب أو سوء المعاملة عند عودته إلى الدولة المعنية، وأن تكف عن إعادة أشخاص إلى بلدانهم الأصلية حيث يكون هناك خطر التعرض للتعذيب أو سوء المعاملة.

According to the author, the members of PA-Amasekanya, an organization involved in efforts to prevent genocide and protect minorities in Burundi, run the risk of being subjected to torture or ill-treatment whenever they voice their opinions or attempt to hold public demonstrations.
ويرى صاحب الشكوى أن أعضاء هذه المنظمة المنخرطة في مكافحة الإبادة الجماعية وفي حماية الأقليات في بوروندي معرضون لخطر التعذيب أو سوء المعاملة عندما يعبرون عن آرائهم أو يحاولون تنظيم مظاهرات علنية.
