The Committee cited as a positive aspect a number of provisions in the domestic legislation of another State party, in particular specific articles of the Constitution and Criminal Code, and the provisions of the National Minorities Act, prohibiting the dissemination of racial and ethnic hate propaganda and the creation of organizations and political parties that are based on racial hatred or discrimination.

(ب) أن تتخذ ما قد يلزم من تدابير تأذن لمحاكمها بأن تأمر من ارتكب أفعالا مجرّمة وفقا لهذه الاتفاقية بدفع تعويض لدولة طرف أخرى تضررت من تلك الجرائم؛

(a) Adopt such measures as may be necessary to permit another State party to initiate legal action in its courts for ownership of [illicitly acquired assets] that are located in its territory, by presenting either:
(أ) أن تعتمد ما قد يلزم من تدابير للسماح لدولة طرف أخرى برفع دعوى أمام محاكمها بشأن ملكية [موجودات مكتسبة بصورة غير مشروعة] موجودة في إقليمها، بأن تقدم إما:

(a) Adopt such measures as may be necessary to permit another State party to initiate civil action in its courts to establish title to or ownership of property acquired through conduct criminalized in accordance with this Convention;
(أ) أن تعتمد ما قد يلزم من تدابير للسماح لدولة طرف أخرى برفع دعوى مدنية أمام محاكمها بشأن إثبات حق الملكية في ممتلكات مكتسبة عن طريق سلوك مجرّم وفقا لهذه الاتفاقية أو بشأن إثبات لتلك الممتلكات؛

(b) Adopt such measures as may be necessary to permit its courts to order those who have committed offences under this Convention to pay compensation, damages or penalties to another State party that has been harmed by such offences;
(ب) أن تعتمد ما قد يلزم من تدابير للإذن لمحاكمها بأن تأمر من ارتكب جرائم مشمولة بهذه الاتفاقية بدفع تعويض أو غرامة لدولة طرف أخرى تكون قد تضررت من تلك الجرائم؛()

Brazil, Paraguay and Peru reported full implementation of measures to permit domestic courts to order those who had committed offences of corruption to pay compensation to another State party harmed by such offences (art. 53, subpara. (b)).
وأبلغت البرازيل وباراغواي وبيرو بالتنفيذ الكامل لتدابير تأذن للمحاكم المحلية بأن تأمر من ارتكب جرائم متعلقة بالفساد بدفع تعويض لدولة طرف أخرى تضررت من تلك الجرائم (الفقرة الفرعية (ب) من المادة 53).

Extending the scope of the draft articles to non-international conflicts would inevitably raise the question of how such conflicts should be defined and how the other State party to a treaty could ascertain whether or not such a conflict existed.
