In fulfilment of her mandate, she has monitored national and regional negotiations concerned, in particular, with the return and reabsorption of migrants who are undocumented or in an irregular situation, as the Commission requested when her mandate was established.

26. As regards migrant workers " who are undocumented " , in the words of the question, a distinction is drawn between the following two cases:

149. At its fiftyfifth session, the Commission, in its resolution 1999/44, decided to appoint, for a three-year period, a special rapporteur on the human rights of migrants to examine ways and means to overcome the obstacles existing to the full and effective protection of the human rights of this vulnerable group, including obstacles and difficulties for the return of migrants who are nondocumented or in an irregular situation.
149- قررت اللجنة، في قرارها 1999/44 الذي اعتمدته في دورتها الخامسة والخمسين، أن تعين لمدة ثلاث سنوات مقرراً خاصاً معنياً بحقوق الإنسان للمهاجرين من أجل دراسة سبل ووسائل تخطي العقبات القائمة أمام الحماية الفعالة والكاملة لحقوق الإنسان لهذه الفئة المستضعفة، بما فيها العقبات والصعوبات التي تعترض عودة المهاجرين الذين ليست لديهم الوثائق اللازمة أو الذين هم في وضع غير نظامي.

Bearing in mind the situation of vulnerability in which migrants frequently find themselves, owing, inter alia, to their absence from their State of origin and to the difficulties they encounter because of differences of language, custom and culture, as well as the economic and social difficulties and obstacles for the return of migrants who are nondocumented or in an irregular situation to their States of origin,
وإذ تضع في اعتبارها حالة الضعف التي كثيراً ما يجد المهاجرون أنفسهم فيها لأسباب عديدة من بينها غيابهم عن دولهم الأصلية، والصعوبات التي يواجهونها بسبب الاختلافات في اللغة والعادات والثقافة، وكذلك الصعوبات الاقتصادية والاجتماعية والعراقيل التي تعترض عودة المهاجرين الذين ليست لديهم الوثائق اللازمة أو الذين هم في وضع غير سوي إلى دولهم الأصلية،

In its mandate to her, the Commission on Human Rights requested the Special Rapporteur to examine ways to overcome the obstacles existing to the full and effective protection of the human rights of this vulnerable group, including obstacles and difficulties for the return of migrants who are non-documented or in an irregular situation.
