To reap the maximum benefits of modern technology, a supportive legal framework is required, one which recognizes the legal effect and validity of electronic data messages and thus adequately facilitates their use.
وللحصول على أكثر المكاسب من التكنولوجيا الحديثة، لا بد من وجود إطار قانوني داعم لذلك، أي إطار يقرّ الأثر القانوني لرسائل البيانات الإلكترونية وصحتها، فيتيسر بذلك استخدامها كما ينبغي(17).

Subparagraph (b) had been added to create an obligation to give notice to possible future parties that there had been exchange of data messages prior to the parties issuing paper documents.
أما الفقرة الفرعية )ب(، فقد أضيفت ﻹنشاء التزام بتنبيه اﻷطراف الممكنة مستقبلا إلى وجود تبادل لرسائل البيانات سابق ﻹصدار المستندات الورقية.

The Working Group noted that the particular nature of the issues raised by electronic substitutes for transferable instruments might require a comprehensive new legal framework in order to allow for the international use of data messages in lieu of the paper-based transport documents envisaged by the Convention.

53. Mr. MASUD (Observer for Pakistan) said that, in article 14, paragraph 2 (a), a distinction must be made between the ordinary transmission of data messages through electronic means and actual knowledge of the addressee as the essence of the transaction.

(e) Finally, UNCITRAL standards, in particular those in the area of e-commerce calling inter alia for legal recognition, admissibility and evidential weight of data messages and e-signatures, proved to be relevant in modernization of civil justice and administrative review procedures.

Adopted in 1996, the UNCITRAL Model Law on Electronic Commerce, along with other legislation has been implemented by a number of States to remove legal barriers, such as requirements for " writing " " original " or " signatures " , recognizing the evidentiary effect of data messages, and permitting incorporation by reference of the terms and conditions of the contract of carriage.
وقد نفَّذ عدد من الدول قانون الأونسيترال النموذجي بشأن التجارة الإلكترونية() المعتمد عام 1996 إلى جانب قوانين() أخرى لإزالة حواجز قانونية من قبيل الشروط التي تقتضي " الكتابة " أو " الأصل " أو " التوقيعات " ، فاعترفت بالأثر الإثباتي لرسائل البيانات وسمحت بإدراج أحكام عقد النقل وشروطه بالإحالة.

Such principles include: non-discrimination of electronic communications (section 11 ECT Act; article 5 MLEC); due evidential weight of data messages (section 15 ECT Act; article 9 MLEC); and freedom of the parties to vary statutory provisions by agreement (section 21 ECT ACT; article 4 MLEC).
وتشتمل تلك المبادئ على ما يلي: عدم التمييز ضد الخطابات الإلكترونية (المادة 11 من القانون رقم 25؛ المادة 5 من قانون التجارة الإلكترونية)؛ وإعطاء الثقل الثبوتي الواجب لرسائل البيانات (المادة 15 من القانون رقم 25؛ المادة 9 من قانون التجارة الإلكترونية)؛ وحرية الطرفين في الخروج على الأحكام القانونية بالاتفاق (المادة 21 من القانون رقم 25؛ المادة 4 من قانون التجارة الإلكترونية).

Furthermore, it was pointed out that practical use of data messages was not confined to the context of contract formation, as data messages were used for the exercise of a variety of rights arising out of the contract (such as notices of receipt of goods, notices of claims for failure to perform or notices of termination) or even for performance, as in the case of electronic fund transfers.
