Early this year the Indonesian Government invited the United Nations Special Rapporteur on extrajudicial, summary or arbitrary executions to visit East Timor.

It had not clarified the circumstances surrounding the Dili massacre, had not released, detained or convicted East Timorese, had not permitted the visit of international human rights organizations and had not invited a special rapporteur or a working group to visit East Timor. It had given very little cooperation to United Nations human rights bodies and had failed to implement any of their recommendations.

In the same spirit, the Commission takes note of the intention of the Government of Indonesia to continue to cooperate with other relevant thematic special rapporteurs and/or working groups, and to invite them to visit East Timor when necessary for the fulfilment of their duties.
وتسجل اللجنة بنفس الروح عزم حكومة اندونيسيا على مواصلة تعاونها مع المقررين الخاصين الموضوعيين و/أو اﻷفرقة العاملة الموضوعية ذات الصلة، وعلى دعوتهم لزيارة تيمور الشرقية عند الضرورة للوفاء بمهامهم.

Furthermore, in spite of the Commission’s recommendation and the Indonesian Government’s commitment to cooperate with the Commission and its thematic mechanisms, no Rapporteurs or Working Group were invited to visit East Timor during 1997. [...] Credible international NGOs, such as Amnesty International and Human Rights Watch, also continued to be banned from the territory.”

In a statement read out by the Chairman of the fifty-first session of the Commission on Human Rights on 1 March 1995, the Commission welcomed the undertaking of the Government of Indonesia to invite the High Commissioner for Human Rights to visit East Timor in 1995 and to submit his report to the Commission on Human Rights at its fifty-second session.
١- في بيان ألقاه رئيس الدورة الحادية والخمسين للجنة حقوق اﻹنسان في ١ آذار/مارس ٥٩٩١، رحبت اللجنة بتعهد حكومة اندونيسيا توجيه دعوة إلى المفوض السامي لحقوق اﻹنسان لزيارة تيمور الشرقية في عام ٥٩٩١ وتقديم تقريره إلى لجنة حقوق اﻹنسان في دورتها الثانية والخمسين.

The Commission further takes note of the intention of the Government of Indonesia to continue to cooperate with the relevant thematic special rapporteurs and/or working groups of the Commission on Human Rights, and to invite them, taking into consideration their requests, to visit East Timor when necessary for the fulfilment of their duties.
وتنوه اللجنة كذلك باعتزام حكومة اندونيسيا مواصلة التعاون مع المقررين الخاصين المعنيين بالمواضيع ذات الصلة و/أو مع اﻷفرقة العاملة التابعة للجنة حقوق اﻹنسان والمعنية بهذه المواضيع، وباعتزامها توجيه الدعوة إليهم لزيارة تيمور الشرقية عند الضرورة من أجل نهوضهم بمهامهم، ومع مراعاة طلباتهم.

Furthermore, the Special Rapporteur considered that the continuing unwillingness of the Government of Indonesia to invite him to visit East Timor “could be construed as being aimed at avoiding direct and independent evaluation of the allegations”.

While welcoming the invitation extended to the High Commissioner for Human Rights to visit East Timor in 1995, the Union urged the Indonesian Government to implement its undertaking to cooperate with the Commission on Human Rights and invite its representatives to visit East Timor and to give greater access to human rights and humanitarian organizations and the international media.
وأضاف أن الاتحاد رغم ترحيبه بالدعوة التي وجهت إلى مفوض اﻷمم المتحدة السامي لشؤون حقوق اﻹنسان لزيارة تيمور الشرقية في عام ١٩٩٥، يحث الحكومة الاندونيسية على تنفيذ التعهد الذي قطعته على نفسها بالتعاون مع لجنة حقوق اﻹنسان ودعوة ممثليها إلى زيارة تيمور الشرقية، وبتوسيع الفرص أمام منظمات حقوق اﻹنسان ومنظمات المساعدة اﻹنسانية ووسائط اﻹعلام الدولية.

3. At the end of the fifty—fourth session of the Commission on Human Rights, the Chairperson issued a statement on the situation of human rights in East Timor, Chairperson's statement of 24 April 1998 (E/1999/23— E/CN.4/1999/167, paragraph 243). welcoming the decision of the Government of Indonesia to invite the Working Group to visit East Timor prior to the fifty—fifth session of the Commission.
3- وفي نهاية الدورة الرابعة والخمسين للجنة حقوق الإنسان، أصدرت رئيسة اللجنة بياناً بشأن حالة حقوق الإنسان في تيمور الشرقية(2)، رحبت فيه بقرار حكومة إندونيسيا دعوة الفريق العامل لزيارة تيمور الشرقية قبل انعقاد الدورة الخامسة والخمسين للجنة.

But it should nevertheless be recalled that Indonesia did not accept the visit of a thematic rapporteur in 1996 and has responded negatively to the requests to visit East Timor made by the Special Rapporteur on Torture and by the Working Group on Arbitrary Detentions, thus not complying with the provisions of paragraph 7 of the Chairman's statement on the situation of human rights in East Timor adopted on 1 March 1995.
